Hi, I am glad this forum exists to help guide people like me on steps to take towards finding a solution to my situation. I am in the process of filing the VAWA , but I do not know what documents to provide as evidence to support my case.

I have lived in US for 5 years and I have been married for a little over a year. We got married in 2019 and filed the I-485 in 2019. My marriage has been difficult and in shambles for the longest time. My Green Card interview is on Monday. But things have been so bad between us... I do not know where my husband is and I am homeless at the moment.

I made up my mind this week to file the VAWA, but I do not know how to go about initiating the process and the documentation to provide as evidence. Also, my husband and I have limited documentation together. The only documents with both our names on it is our Marriage License and the 2019 tax document.

Is there anyone who can guide me in regards to documents to provide in support of my application? Also, what should I expect for 'No Show' interview status? In addition to that, can I possibly use a P.O. Box to get my letters pending when I have a physical address? Any help I can get will be greatly appreciated. Thanks in advance for your help.

Hello, welcome onboard. We have tons of existing posts on document and evidence checklist. Kindly go through previous threads. For myself although i had a lawyer I went through atleast 10 threads to gather general information. I was able to interfile documents based on information provided by kind people here and got approved without rfe. My lawyer wasn’t thorough enough.

Kindly take time to understand the process from available resources on old threads and post any specific questions you might have once you get an understanding. There are amazing people here who offer help unconditionally. Glad you found this forum! good luck 👍🏽😊

Hello I was reading below given content. How true is it?

If you ask them to put the i485 on hold or abeyance, you would not be able to renew the COMBO CARD until after the Vawa is approved between 18-22months but would not be put on deportation process if it gets denied for any reason even though the i485 would be denied

Hi guys I'm not a frequent person here on this site I just browse through occasionally. But I had to leave my info here so persons will feel encouraged and know that their time of approval is coming. Just stay strong and don't just depend on your lawyers to push your case for you because you are just another case that they have even though they maybe trying their best to assist you. Reach out to your representatives because they'll assist you. Just google your nearest representatives their information will come up! Wishing everyone a speedy approval.

Field Office - Federal Plaza NY NY

July 2020 -  Reached out to a NY Senator to assist me got back an email couple days after from her office saying there is an officer reviewing my file and they will make a decision in my case within 90 days which they didn't.

Dec 3, 2020 - RFE for i-693 medical, which I didn't get in the mail but by email from USCIS for me to submit it before March 2 2021 after I reached out to every congressman/senator in NY for assistance which they replied.

Dec 9, 2020 - i-693 medical submitted.

Dear wonderful Forum members. Greetings.

I got an update on my case twice this week.

I filled Vawa in Feb, 2020 and my timeline are as follow; (I-360, I-131,I-765(C-31) & I-485

1. 10th Feb,2020 - Receipt notification received

2. 6th March,2020 - ASC appointment letter (cancelled due to COVID)

3. 26th March, 2020 - Prima Facie letter covering 1 year (March 2020- March 2021)

4. 19th October, 2020 - ASC fingerprint taken and applied to I-765 & I-485

5. 4th January, 2021 -  case status shows fingerprints updated on I- 131

6. 8th January, 2021 - received a mail and status changed to Card/Document production on I-131

Am a bit confused here, why was the card/ document on I-131 alone? Also, since my I-765 application category was on C-31. And no update on the I-130 yet. Which card should I expect.

thanks

You will not receive a I765 (C31) until your VAWA is approved.  So your travel document will be a paper document only.

Thanks. Is this normal? I mean, why process the travel document alone.

You need to decide if you want to file VAWA or to  continue with your abuser, what it's a terrible idea, but  you can't have both!. If you want to file VAWA go to the interview alone, and of course don't tell your husband, inform  the officer that you will file Vawa. Ask if he/she  can hold your AOS until final adjudication of your Vawa petition. If your husband withdraw the sponsorship then USCIS will deny your AOS and you just need to refile if this happen ok.

Hi Sandranj, I have the issue. My AOS interview is on Monday and I am in the process of putting documentation together to file VAWA. The issue is that I will not be able to file my VAWA application in time. It is too late now. Should I go to the AOS alone and plead that my AOS should remain pending?

It is a separate application, so they will process it.

C31 EAD doesn't come as a combo, so parole will always be processed separately and arrive as a paper rather than card. Was your spouse a US citizen or a gc holder? If he/she was a citizen then you should submit another EAD application and put a category C09. It is free of charge and you can have it while you wait for VAWA approval. If he/she's a gc holder then yeah you can receive paper parole and wait for C31 EAD after VAWA approval.
