Hello all,

Happy New Year

Is it advisable to file unemployment If one looses job. Vawa is already approved. Awaiting AOS (which is way past PT).

@sandranj @Stillwinning!!!😊 and anyone with useful info should please help. GC/citizenship is very important in my line of work. Getting a job with just EAD is not easy.

Happy New Year darling!🎉🎊😘 Yeah you can file only if you're eligible! It won't affect your GC!👍

Yes i am confused for real. I don't understand maybe the difference between individual hearing and master hearing. The court notice says master hearing. I haven't yet been questioned about the asylum. I went to the master calendar hearing, and the other hearing the lawyer filed a motion to continue

Sorry I meant to write that you had already your MASTER  hearing and I wrote you had already your individual hearing. For sure you had the master ,the next one will be the individual hearing.

Please can someone tell me how to go about this. My i485 interview is scheduled for next month Jan, but i want to switch to vawa. Is there  a way i can do this without filing for another i485,i will call have to reschedule, is it possible to maintain priority date. Please help me

You just can keep the I-485 if your spouse doesn't withdraw the I-130/I-485.

Keep calling for an infopass. Unfortunately the phone center is being very inconsistent in how they are currently handling infopass requests. Some people are given appointments and others are denied even though they are asking for the same reason. :(  So keep at it until you get an agent who will schedule you the appointment. Also when they call back its typically from a blocked number or can show up on caller ID as 000-000-0000. You MUST answer when they call. They will only try to call you once, if you dont answer thats it, you are removed from the call back list and have to get back on it again. It can take them 1-3 days to call you back so you have to be ready to answer the phone at any time.

Informed delivery is a service by the post office that you sign up for and they email you pictures of what mail you should be getting each day in your mail box. Its a nice thing to have in general but it wont help you to know whats going to be in your mailbox if the mail you are looking for is going to the attnys address.

HR at your job are typically the ones responsible for verifying employees work auth status. If they havent asked you for an updated work auth document yet they will as soon as they realize they need it. Verifying your work auth is their responsibility not yours but you will have a problem if they ask for it and you dont have it. At this point in your immigration process you are an LPR. You dont have the card in hand but that doesnt matter. The card is not a status. Status is not a tangible object- the card is simply a tangible object representing your status. The 551 stamp at infopass is the same. So you either need them to mail you the physical card or obtain a 551 stamp.

If you continue to struggle trying to get a stamp for work purposes you may want to consider a different approach. I would never suggest you lie about the reason you need a stamp but I am sure this whole thing is very stressful for you and you would benefit from a vacation right? A beach in Mexico sounds nice and to do so you need a 551 stamp so you could request one for upcoming travel purposes.  They may be more likely to approve an infopass for that.

Made the final call to uscis today. The rep said I am not eligible to get I-551 stamp in the passport. The reason is that only those who renew green card, remove conditions from green card or applying for citizenship with expired green card - can get the stamp. Is it a BS or are they right? I asked from different angles and got the same response. The rep seemed to be knowledgeable. The rep said though that one can present approved I-485 letter to employer and it will work just fine.

All the above is new to me and a bit shocking. Please let me know your thoughts.

Yes he is abusive and still  willing to go to the interview. He is abusive and i reached out to the hotline. And they advised me to leave and file vawa. Although we have made up. Its really a confusing situation for me. Its always good times, then abusive and make up. We could just wake up that day and my husband would decide to leave me hanging. I never know what to expect any min from him. Its so hard to leave. I called a shelter sometime in March and they wont take me because of covid.

Do not let a man disrespect you for one minute. Seek therapy to develop self esteem and self respect. These two things get lost while living with an abuser. Did he participate in anger management classes for at least 6 months? did he attend individual therapy for at least 6 months, if not then you are wasting your time. Seek help.

Hi Stillwinning, when you go to the interview with your spouse, how do you communicate you want to file the I-360 in front of them or do you pull the officer aside before you go in?  Can you possibly go about it by requesting for an infopass meeting and then telling the officer that you have an upcomig interview for AOS but would like to file I360?

You need to decide if you want to file VAWA or to  continue with your abuser, what it's a terrible idea, but  you can't have both!. If you want to file VAWA go to the interview alone, and of course don't tell your husband, inform  the officer that you will file Vawa. Ask if he/she  can hold your AOS until final adjudication of your Vawa petition. If your husband withdraw the sponsorship then USCIS will deny your AOS and you just need to refile if this happen ok.

Yes all the hard copies of those documents will be needed.

I havent started a I 360 as yet but I would have to do a 3 year vawa cancellation of removal. Not quite sure how to do it and its expensive to get a lawyer at this time.

I used to be on here alot but since this happened I have alot going on.

Once you will file VAWA cancellation of removal is because you are in removal, but why don't you file the VAWA petition through  USCIS? If the USCIS approves your VAWA you can adjust status with the judge or you can ask to terminate your removal and then adjust status with the USCIS.

Hey @sandranj. Thank you for answering my questions. Since i am in immigration proceedings with master hearing coming in April 2021 and with pending i360 and since I sent my i485 to IRVING tx(it was for fee payment purposes), do I have to send another i485 to Vermont? Or USCIS irving tx will transfer that i485 to Vermont for processing? What should do in this case?

Bring to the Court proof that you filed VAWA and ask the Judge for an individual hearing. The AOS must be always submitted to Vermont. The Irving filed will transfer to VSC.
