We should let the medical people interpret the images, or we'll all go crazy.

You are most likely going to have to file a new 485. You can submit a fee waiver if you need to.

You didnt list out all the dates but from what you have posted it seems in 2018 you had a joint AOS interview scheduled and you advised them to hold your 485 as you filed VAWA. They did. You then were able to renew your EAD because of such. The 485 can only be held if the 130 is still active. Imagine it like a tree branch at the top of a very tall tree. The branch is the 130, the leaf on the end is the 485. You are asking them to climb up on a ladder and remove the leaf from the 130 branch and attach it on to the 360 branch. They can do this- as long as both branches are still attached to the tree. Once the 130 branch is cut off (withdrew) the leaf dies and the branch falls to the floor, and they can not climb down and pluck it off and attach it back up top to a different branch.

It seems you were able to renew your EAD because either at the time you renewed the 130 was still active (so your 485 was too) or it was an error on their part. Kind of like they cut the 130 branch but as it fell it got caught in the brush and didnt quite hit the floor to be considered 'trash'. It will be though once they shake the tree and clean up. Thats what the wording of 'most likely' is based on. Perhaps they havent officially trashed it yet but it has to be trashed. They can not remove the leaf from the branch once its cut.

The only way you do not need to file a new 485 is if the 360 was approved before the 130 was denied.

If your 360 has been approved you should have gotten a c31 EAD. You can use that to work. The c31 EAD is work only- no travel auth. If you need travel auth you will want to file the 131 along with a new 485. You should not travel using the combo card you have (the one based on the previously filed 485) because even though the system says its valid it shouldnt be. They are going to figure that out at some point and if they do while you are outside of the US you wont be allowed back in.

To avoid further delays you should submit a new 485 asap.

@Villanelle   Thank you for you help and more than convincing reply.Yesterday my attorney sent me a email explaining that before the withdrawal of I-130 he filled paperwork/petition to INTERFILE I-485 with I-360.As per her version, the USCIS had to deny inter-filling petition, before denying I-485.  He further says that on the basis of inter-filling process, USCIS denied I- 130 but sent the file with pending I-485 to VSC. Today she filled case enquiry and she is 110 % sure my I-485 is still pending.

It won't be out of place to let you know that he didn't charge me a penny to file my Petition I-360 and  is in the practice for the last 22 years, and in such situation I cant argue with her.

But please you guide me is there any inter-filling process to attach AOS with other petition? and should I wait or file anew I-485  right now. Thanks

Hi Fam!

After I filed 360,485, and ead with ap, I had a biometrics appointment for 485 on December 1st.

Same day it showed online that fingerprints were taken and applied to my case.

Now I just got another biometrics appointment again for i485 for January. Why 2nd time? what's happening? 🙄

Hello Every one,

Am very worried today i went for medical and i was diagnosed TB POSITIVE, don't know what to do  am really stressed out. will they deny my medical and i-485 application ?

Sorry to hear that.

What i know of is if you are positive with TB you will need to undergo treatment first before the doctor clears you. Therefore they cannot grant you any decision yet with your petition because your medical is not clear.

If they do skin test and you are positive  then theyll do xray and if you are positive again you can request a blood test for tb. My latest medical, they just did the blood test straight  away.

See if it works.

Goodluck to you

Stay safe and God bless always

They may need to retake your prints do to an error when taking your prints the first time or The second point mente notice may have been sent to you by mistake. Since 2014, USCIS has erroneously scheduled some customers for more than one biometric appointment.

Since you have already attended an ASC biometric appointment, you might not need to go to a second biometric appointment. Call the USCIS Contact Center at 1-800-375-5283 to confirm if you do or do not need to return to the ASC to have biometrics collected again.

I was hoping someone can offer some advice.  Right now I'm filing for VAWA and the case is ready to be submitted.  Yesterday I was served papers from my ex-husband.  I really don't know where to go from here.  I don't want to sign off on the offer the lawyer gave me.  The amount of spousal support he gave me was $600 a month.  I'm in need of a lawyer, but cannot afford one right now, because I don't have my EAD/AP card yet.

Is there any resources for an individual in my situation?

Lawyers often give free initial consultations (30 min, at least).  By calling around, you might get several of these and get an idea of strategies, procedures, or both.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

So do you think he's going with you to disgrace you or he's going with you to make sure you get your green card? You to need figure it out.. you're the one in the relationship and you know the pattern so you're able to answer these questions.. but however if you feel threatened, you would have to leave the house immediately and find shelter somewhere with friends.. relatives.. wherever.. away from him then go to USCIS and let them know your situation. You must file vawa immediately if this is the case because you're going to need to present the receipt as proof before I-485 will be held! But even if you inform the officer before you file I-360, they'll give you some time to bring the receipt in!👍

No dear. He won't.  Although I don't know what mood he would  be. But I don't think I should go to a marriage interview with him if the marriage is abusive. I was thinking postponing  the interview to buy more time, so if i do that where do i tell him i am going to on that day. That would make him suspicious.  That's why I want to know if it something i can do over the phone.

Try the infopass.. I mean try talking to an officer let him know the urgency of the situation and see how it plays out and do it ASAP! Also desperate situations calls for desperate measures you do not need anyone to help you come up with what to do.. get creative, survivors have one thing on their mind... TO SURVIVE!👍

There are attorneys that can help you for free or very discounted fee... you just have to Google.. there're also lawyers from Catholic Charities and other organizations like I said Google! Hopefully you come up with something to help save your situation!👍
