If you are not inΒ removal proceedings, Β and don't have an asylum pending you will be able to reenter, but you must check covid restrictions tho.

Hi Sandranj, from individual hearing to another master hearing ? Is that means you gonna have two individual hearings?Β Β am a little bit confused , can you explain this for us please. ThanksΒ

Everyone has one individual hearing, in the Β individual hearing you will have to tell the Judge why you need a master hearing, once you explainedΒ and Β if you have basis for aΒ Β master hearing then the Judge will set up the master hearing.

Hi @DemiseΒ happy holidays. Please I need help with a situation. I did asylum in the past years ago they asked for more informations but I didn’t understand English back then and didn’t have a lawyer therefore I failed to reply to their letter. USCIS then sent me an intent to deny letter. Now several years later I’m applying under I-360 category. With an advance parole I was wondering if it’s safe for me to leave the country or I should file something to remove the removal first. I have not seen any of my family members for many years. Even if it’s not in my home country I would love to meet them somewhere else. Or should I just not travel?Β
Β

thank you so much for your help or to anyone in this thread who have an answer for me.Β

If you leave you won't be able to reenter. You departure from the U.S. will trigger your ground of inadmissibility.

Hey @Demise, let's assume the i360 is approved and i485 pending with court. Can I ask the court to schedule an individual hearing to adjudicate my i485? I am having a master hearing end of April. Or I can ask the judge at my master hearing to schedule an individual hearing?Β

Β

You are confuse. You had already your individual hearing thenΒ Β forget about individual hearing. If USCIS approves your I-360 before April then in yourΒ master hearing Β you can adjust your status, if your VAWA is still pending in April thenΒ you can Β ask the Judge to postpone the masterΒ hearing until final adjudication of your I-360.

I dont think you can file i485 if you are in removal proceedings if that is what you meant by proceedings. Sorry I might be wrong.

She can file form I-485 if she is in removal proceedings, and when the I-360 is approved Β she has to ask the Court to terminate the proceedings in order for her to attend the AOS interview with the USCIS.

He asked if he could refile the AOS for example if he Β divorced Β 2 years ago, Β and you answered that he canΒ Β reapply. Your information is incorrect.A person can file a VAWA petition just within two years of the end of the marriage.

Yes i am confused for real. I don't understand maybe the difference between individual hearing and master hearing. The court notice says master hearing. I haven't yet been questioned about the asylum. I went to the master calendar hearing, and the other hearing the lawyer filed a motion to continue

The Court can just decide your case in Β your Β individual hearing, not in the master hearing. It seems you will have the master hearing.Once the VAWA is approved you can adjust status with the Court, but I do not recommend at all. From the individual hearing to the master hearing can take between 8 months to 3 years.NYC is taking 3 years to schedule the master hearing.

Hey @sandranj, here you said i can adjust in the individual hearing. And the other post you said at the master hearing. Can you clarify please?
