Considering that the court can't do much about I-485 until I-360 is approved, the judge would likely just keep scheduling master hearings until a decision on the I-360 (positive or negative) is made simply because there's no point for the court to schedule out an individual hearing during which no decision can be made.

 

Is it possible for a individual hearing to be inconclusive and you end up with another one later? Sure, but that happens mainly in convoluted cases like cancellation of removal cases where basically once every year or two you have to re-argue that you still qualify for it while you wait for your number in the queue to pop up.

 

Also, keep in mind that the court has no jurisdiction over the I-360, so your individual hearing will just relate to issues of admissibility and whether you warrant favorable discretion, which as long as you are not a criminal or otherwise inadmissible is nothing to worry about.

Contradictions without citations only make you look dumb.

Hi @Demise happy holidays. Please I need help with a situation. I did asylum in the past years ago they asked for more informations but I didn’t understand English back then and didn’t have a lawyer therefore I failed to reply to their letter. USCIS then sent me an intent to deny letter. Now several years later I’m applying under I-360 category. With an advance parole I was wondering if it’s safe for me to leave the country or I should file something to remove the removal first. I have not seen any of my family members for many years. Even if it’s not in my home country I would love to meet them somewhere else. Or should I just not travel?

Don't travel since you're in removal proceedings. I applied for asylum too and I'm in removal proceedings with pending i360. I lost my father in 2017 and my grandma this year but there is no way for me to travel until i get my green card

Hey @Demise, let's assume the i360 is approved and i485 pending with court. Can I ask the court to schedule an individual hearing to adjudicate my i485? I am having a master hearing end of April. Or I can ask the judge at my master hearing to schedule an individual hearing?

Hey @sandranj, thank you for continuing to help. Yes, I'm having a master hearing in April. So what can I do in this case? File a new i485 with Vermont once my i360 is approved? Because you said the i485 that i filed last month with uscis irving texas will delay my case to be transferred to Vermont. Or ask the judge at my master hearing to schedule an individual hearing? I am in missouri state

Wisdom on your part! And sorry for your loss.. you did the right thing I adviced her same..it probably would be believable if she hears it from 20 different people!💁

Do you confirm you're in removal proceedings? if this is the case it'll be safe for you to remain here until you get your green card before you step foot out of the USA. I know how it feels not seeing your family for a really long time  but you need to do what you need to do or simply make a choice!👍

Thank you so much for your reply. After the intent to denial I didn’t hear from them. So I’m assuming I’m in removal proceeding. You are right I waited I waited 10 years I can wait another 2 or so. I can here so young 😭 I was underage when I arrived. 😭
