Hello house ,

  @Stillwinning!!!😊 @sandranj please I have a little question to ask 🤣🤣🤣,I sent my RFE last month and they have received it at Vermont but they have gotten back to me and it’s not over 1 month ..so I went to my lawyer to file for the renewal of my Work permit ..I sent the i765 renewal but usps didn’t deliver my package for more than 2 weeks now ,is not tracking anymore ..just in transit and I dnt want my work permit to expire before I get it renewed that’s why I hurriedly sent it in but usps is so unreliable these days ,they might have missed my package ..now am thinking of sending another i765 cause my work permit would expire by March ..and my drivers license will also be expired to so I want to get my work permit renewed and I  dnt wanna act complacent atall cause complacency can destroy ones life ..now I told my lawyer that what happen to the mail we sent in at usps ..my lawyer told me he’s out of the country and he won’t be back not until next year March 🤣🤣..so I want to ask if I can do the renewal of the i765 myself and send it through Fedex or go to another usps location that is reliable and sent through express ..I dnt just wanna feel complacent atall..I need to act ..cause I dnt want to be told any stories that touches the heart at my place of work !! Please advise me if I can’t send fill out the i765 renewal form by myself without the lawyer and put the lawyers address as the sender !! Just advise me what to do ..I had that in mind but I just decided to ask people on this page ..

Hello there, everyone is different I guess but if I were in your shoes I will not attempt to travel until I have my green card but then if you must travel it shouldn't be to the country that you were supposed to be seeking Refuge from..petitions of Asylum filers are often looked at as frivolous.. I mean if they're able to travel to a country that they're supposed to be seeking Refuge from... then it's hardly believable! Even now that your I-485 is VAWA based.. the issue might resurface at your Green Card interview so be careful... except you're going elsewhere! Just my opinion otherwise safe trip!✈✌

Hello Family

@dreamer1 @Stillwinning!!!😊 @sandranj

My EAD based on pending I-485 is going to expire in the month of April 2021. Also, I dispatched my complete package with I-360 in November 2021, as of now i didn't receive any receipt notification. My questions are.

1. Can i submit Travel Document application with EAD renewal.

2. How much it will cost me, EAD Renewal + Travel Document.

3. What documents i will have to attach.

Yes you can send in the advance parole application alongside your EAD renewal I believe...but you should know that your EAD renewal is free due to your pending I-485. The old fee for the advance parole according to USCIS was $360 the new fee is $575 (wait for other contributions to verify) documents you would need to attach for the EAD renewal includes a copy of the EAD you're trying to renew, the I-485 receipt notice two passport style photographs, the completed I 765 and i-131 form, copy of your state issued ID card...these are all I can remember for now. Also I recommend sending in the documents in January!👍

In this particular case since you are in removal proceedings, the immigration judge has jurisdiction over the I-485 (as per 8 CFR 1245.2) and would normally issue a decision during the next individual hearing after I-360 is approved.

If you were to get the proceedings terminated, then Irving, TX won't transfer the I-485 to Vermont because there's nothing to really transfer, what you filed with them is just the form so they'll give you a receipt that you will then give to the court to prove that you paid for the I-485. In case like this you'd file a new I-485 packet with Vermont and attach the order terminating proceedings (which returns the jurisdiction over I-485 back to USCIS) and the prior I-485 receipt as proof of payment.

Thank you very much for this. When  I will file a new i485 with my old receipt. Will they consider the old receipt priority date or it will have that new priority date and new receipt date? As of now, the receipt date is November 2020 and the court sent me a receipt as well still 11/2020

Hello vj family @sandranj @Demise. Can I know if my i485 will be transferred to Vermont after approval of i360 or before approval of i360?

I'm in immigration proceedings, I Filed i360 October 2019 and filed i485 at uscis irving TX November 2020. How long does it take uscis irving texas to transfer i485 to Vermont?

I dont think you can file i485 if you are in removal proceedings if that is what you meant by proceedings. Sorry I might be wrong.

Hey dear long time, I hope you're keeping safe? anyway Congressional inquiry remains a very valuable resource you should inquire through your Congressman or senator...I went to three different offices, if one isn't productive try another! Sometimes these cases take long and it's different for every case... so just be patient while waiting for a response from your Congressperson okay? it's not an easy journey.. but you'll be alright!👍😊

Thanks Stillwinning.

Found this. I think it would be helpful to you.😊

Checklist of Documents to File With Form I-131

Here are the items you will need to include with your Form I-131:

  • Filing fee: If you have already submitted a filing fee with your adjustment of status application, and that application remains pending, DO NOT send an additional filing fee for the advance parole application. It’s free if you send it with or after your I-485 (as of early 2020, though this might soon change).
  • Passport-style photographs: if you are sending the I-131 together with the Form I-485 and a Form I-765, Application for Employment Authorization, include a total of four photos in the package. If you are sending the I-131 after the I-485, include two passport-style photos with the I-131.
  • Photo identity document (with photo, name, and date or birth): if you are sending the I-131 together with the Form I-485, you will be sending a copy of your passport identification page, which will be enough. If you are sending the I-131 after the I-485, include a copy of a photo identity document, such as your passport identification page or driver’s license.
  • A USCIS-issued document showing your present status in the United States: If you have a legal status in the U.S. that was granted by USCIS, you should include a copy of your approval of status notice from USCIS. If you have no such document from USCIS, there is no need to include a status document.
  • If you are sending the I-131 after the I-485, a copy of Form I-797C Notice of Action showing that the I-485 was received by USCIS.

Hello all! Happy upcoming Holidays!

@sandranj @Stillwinning!!!😊

I hope you can answer my question, you are always so knowledgeable and helpful!

I am in NYC

My Vawa was approved in August 2020, and my i485 was filed back in 2017 (when I applied for it based on marriage with my abuser husband). Because of the escalation of our conflicts and my mental state, we didn’t attend the interview for that i485 with my husband, as I was already consulting with my attorney about filing of my Vawa case.

The attorney mailed the USCIS request to keep the i485 in abeyance (10 days before the day of the interview that we were supposed to go to with my husband), and he gave me a receipt of that letter being received by USCIS. BUT, the status of my i485 after the day of the interview passed, was changed to “Nobody showed up for in person processing”, and this status is still there showing up to this moment (since 2018)

my question is @sandranj and @Stillwinning!!!😊 should I be worried that maybe the USCIS didn’t keep it in abeyance? Do they send some kind of note, if they cancel i485 or refuse to keep it on hold?

And How can I check the status of it, if it is still active? According to this forum, I should have received something about Updating my Medicals, but I haven’t received anything.

Thank you very much for any input for my question! and stay safe!
