Who got Request for Additional Evidence I filed 3 moths ago and really worried about it

Short timeline:

07-24-2020 - filed i-360 and AOS.

09-18-2020 - USCIS sent a Request for additional evidence for a proof of good moral character on a I-360 petition.

Lawyer had me get a digital fingerprint card from a private firm and mailed it to FBI for a Clearance certificate. It took almost 2 month to get a reply.

12-07-2020 Lawyer sent reply to RFiE

In the meantime I've got a Biometrics completed on 11-30-2020. USCIS updated online the very next day.

RFE is not scary, it will add time to the bottom line, but it also is a sign that someone is actually working on it. Just be sure to read it really careful and reply on time. With Covid they let you extend reply time for additional 60 days.

As far as I can see /please correct me if I'm wrong/ Initial Evidence is usually referring to identity and admissibility (like birth certificate, passport copy, missing crucial document or signature?). Additional Evidence is for the next step, mostly eligibility  - about marriage, previous marriage, abuse, moral character. Most of the time RFE is a formality that was overlooked or missed during initial filing and they give you a courtesy chance to fulfill the request. NOID is the more serious matter. It is almost a denial with final chance to make things straight. Hope none of us will ever have to deal with it!

Good luck and Godspeed for more and more approvals!!!

Good question. I wonder the same thing.

I received my RFE after 18-month of waiting. It was a GMC under my maiden names. Interestingly, there isn’t a deadline on mine.

@Ylx Gotcha! Thank you! When I mail them to the USCIS, do I have to include the USCIS officer's name in the address? Or just put the USCIS's address(without a specific person's name) is fine?

Hi there.

Mine didnt came with to a person just to an office address. If your letter at the end said the address to be sent and also include a person my guess is include the the person. Just my thought!

The Court can just decide your case in  your  individual hearing, not in the master hearing. It seems you will have the master hearing.Once the VAWA is approved you can adjust status with the Court, but I do not recommend at all. From the individual hearing to the master hearing can take between 8 months to 3 years.NYC is taking 3 years to schedule the master hearing.

Thank you. Will just do it with uscis and hoping my i485 will be transfer to Vermont as soon as my i360 is approved

she kind of get pissed with the interpreter because was not translating every word (the officer speaks Spanish).

This is really funny, for several reasons -- first, the officer was probably frustrated by not being able to conduct the interview in Spanish herself*.  Second, my understanding is that there's also supposed to be an "observer" -- a third party on the phone who ensures that the interpretation is accurate.  Third, I personally know a conscientious Spanish interpreter who would be appalled by the story about yours.

Without even knowing you, I'm sure that you're just fine.  A lot of native Spanish-speakers doubt their abilities when they're really quite good.

Is this normal?

I'm confident that Stillwinning is correct, and I agree with her that you should relax. :)

*When Mrs. T-B. did her naturalization interview, she said that the Latino officer apologized to her for having to do the interview in English.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

Thank you for your response. It never said anything about frivolous asylum, would that have to be the specific wording they use? NOID had details from the interview where the officer felt like I was inconsistent in my answers, and in the end it says " Considering the identified credibility issues, the absence of reasonable explanations for those issues, and taking into consideration you individual circumstances, your testimony was found not credible under the totality of the circumstances. As your testimony was not credible in material respects, you have failed to meet your burden of establishing that you are a refugee as required by 8 C.F.R. 208.13(a). Consequently, you are ineligible for asylum.". Final denial just referenced NOID reasoning.

I guess the paragraph they quote is different from the one you just mentioned, which is good?

There is a difference between filling a frivolous asylum application and simply being found not credible. To be considered frivolous the Judge must make a specific finding  that the person knowingly  filed a frivolous asylum. The asylum denial won't be a problem for you considering the Court findings,BUT you might have a problem because you travelled to your Country after stating in Court you feared for you life, it doesn't matter if someone was sick, that being said you have to wait to see how it will unfold your case.Good luck.

Good morning my VAWA family I just wanted to share my interview experience:

My interview time was 9am, I arrived at 8:45. Just 9am in the morning the officer called me, she seems to be very nice, she asked me about my attorney and interpreter, I said they’ll be by phone. She asked me my id and passport and took copies of them, then she asked me basic questions, she corrected 3 question in the form. At some point she kind of get pissed with the interpreter because was not translating every word (the officer speaks Spanish). The officer told me that my English was very good and I told her that I just wanted to make sure I understand everything because of nervous. She asked me the NO and Yes question ( she had a very strong looking at me, but I did Eyes contact all the time. The interview just took around 25 min...

then she said “ ok, we corrected 3 questions in the form, please sign here and you should have our decision  Mail to this address in the next few days”

Is this normal? Based on your experience? How long it would take to have the decision? 😭😭😭😭 this wait is endless!!!!!!

thank you in advance

You should get the green card within 10/15 days.

Hello all !Is it normal to receive a request for initial evidence even after receiving a courtesy letter 2 weeks before? What could that be? I thought they will send me an interview notice at this point. (Checked my uscis case status and they sent it today. I'm nervous)
