You are illegal considering what you posted, but you are not going to be deported, they are deporting people involved with terrorism, espionage, someone convicted of aggravated felonies etc, they are not deporting people with a VAWA pending.

This is what i had.

- 4 Pictures

- Marriage certificate

- Costco Membership Card

- Flight Booking ticket

- Affidavits from friends.

- Psychologist Letter to prove that i was mentally abused.

 

After submitting all these documents i got RFE in Good Faith Marriage and Joint Residence

- I did not have any extra proof so my lawyer suggested that i get extremely detailed affidavit from friend.

- I got Affidavit from, My friend, 1 of Her Friend and 1 Neighbor. ( All 3 People had submitted their government ID as well )

 

These affidavits described how we met, how we fall n love, when and how we got married, what was out life before marriage and after marriage.

This is a google search and go for images you will find many decision letters provided by explaining why they did not approve particular case. I went through almost 50 of these letters so i know what to write and what not to write in affidavits,

 

I responded to my RFE on Nov, 23-2020. and i got my vawa approved in Feb-25th.

 

read as many notices you can make your story compelling and very detailed.

@Nick2020 thank you so much for helping me. I have no words to show my gratitude. Information you shared will be very vital. I thought if we apply through attorney, we dont get such RFE's. I am glad you responded or else i would have hired attorney and didnt know what to do, I will study these in details and prepare my statement. Problem is I do not have friends who are ready to write about my marriage and abuse, They are too afraid to get  into legal situation. I dont know how to convince them.

First you need to stay calm to think properly.. I got 3RFEs as well and believe me I didn't have so many documents however I made certain to explain in detail anywhere there was insufficient evidence.. I will advice you do the same.. also the 3rd party affidavits have to be very detailed not sketchy.. they have to demonstrate in written form the depth of their knowledge of your situation. No document is irrelevant bring them all.. if you can think of it, its relevant add new evidence to already submitted ones alongside detailed personal and 3rd party evidences and you should be good!👍

Hiring an attorney doesn't always mean success in this journey as you've seen here.. a lot of petitioners filed themselves and were successful. If your case is not complex, then it makes sense to file yourself.. however we cannot rule out the fact that hiring an attorney who knows what they are doing can make a difference only if your case is (complicated like I mentioned above) You have to find a way to convince your friends that writing an honest affidavit would not get them in trouble.. if all else fails you will have to put your all into a heavily saturated personal affidavit leaving no stone unturned. In my 18paged affidavit, I managed to capture details spanning a two year period before during and after marriage!👍

They told me I am barred because of immigration fraud citing 204c. While I divorced since July 2019. I didn't understand how they made a decision on an application that I divorced my petitioner long ago. I am preparing already for RFE for my vawa filed October, 2019. Hopefully I Will debunk all their points that I believe didn't make sense to me because I know I married for love and when I saw the abuse were becoming too much I divorced her. I had the i130 interview November 2018 and RFE same month. But the decision came 2 years after, February 2021 denying my i130 and citing 204c bar to me. Now I can't even appeal because I'm divorce already. Hoping to reverse their decision at vawa RFE

Seems our cases are little different, i am so sorry for agony you going through, i hope you will receive VAWA approval, Thank you for getting back to me,

Thank you for prompt reply. I agree, my problem is lacking documents, but i believe hiring attorney will not make much difference in that too, I can get some directions here and handle it on my own as i know my situation. I needed to know if RFE i received is something really serious and i need to worry about it or it is usual for people to get one like this. I will need to write my statement surrounding my RFE now. Great you got such valuable info from Nick2020.. I'm sure you'll be alright.. everything that's hot gets cold at some point. My journey ended a year and some days ago..VAWA approved March 2019 Greencard March 2020!😊👍

Maybe this will help give you strength and reassurance.. someone here received 5RFEs fast forward they have their GC now! I received 3REFs and I have my GC as well! Your response should address everything USCIS raised.. build your response around it! The first time I read my RFE, I burst into tears mainly because I didnt have anything more than what I already gave but once I calmed down and went to work on building my response based on all issues raised my hope was restored! I know you can do it too my friend!😊👍

Good afternoon VJ Family hope everything is having a great week so far? I have a quick question is it normal to wait 18 months for a AOS interview? Any suggestions?

Yes it is, specially on those state which local office have a higher case load. Interviews are taking 14 to 24 months.

Folks I know this thread is about VAWA,but  I need a healing  prayer for  a friend  with COVID. She had a baby 4 days ago, she doesn't even know that she had a C-section, and she has a  baby boy. She is in a coma and intubated, and unfortunately her kidneys stopped working and they started yesterday  dialysis. Her case needs a miracle, second the doctors.Her name Nadia, she is a pastor and very young (34 years old).I believe in the power of prayer. Thank you everyone .
