Do you think Infopass will able to get me copy of my RFE? Last time i was at there office, they said they are not able to update my address. Not even able to accept I-131. that was odd.

Oh wow, I submitted mine August 2016 and my vawa was approved on Feb 24,2021🙄 my lawyer advised me to send a letter with the approval. I need my GC ASAP, need to go see my parents soon .

I don't know how long it is going to take for the GC. Do you have a travel document? If not better to apply and wait for the GC at the same time. God be with all of us. It is a very hard and long wait but we are almost there.

Anyways, to give you the run-down, you cannot petition for a new spouse unless (any of the following):

1. You've been an LPR for at least 5 years

2. You've naturalized and are now a USC

3. Your prior marriage was terminated by death

4. You prove by "clear and convincing evidence" (>75% threshold of evidence) that you entered the prior marriage in good faith.

 

So you've got 3 options:

1. You could file as soon as you're an LPR and include any and all evidence that your last marriage was legit (this might be more than what you needed for your VAWA since that generally only requires "preponderance of evidence" (>50% threshold of evidence)).

2. You wait 5 years

3. You naturalize

 

tl;dr: Yes you can naturalize instead of waiting 5 years and cut 2 years out of the waiting time.

 

Hi Demise, thank you so  much for clearing my confusion, it's so much helpful to understand this complicated situation now.

 

So based on the information you provided, after getting naturalize after next three years (~Feb-2024 for me as my GC approved in Feb-2021) and becoming US citizen we can sponsor new spouse, is that correct? In that situation it's only three years of wait time.

I sent renewal for c9 a week before vawa approval. I am scared to travel lol. Should I apply for travel document? How much that cost?
