Good morning. Do I have to send in the approval notice for the I-360 with our I-485 applications? My daughters and I are going to start gathering documents next week, just want to know if we have to wait on the approval notice to actually send it in. We haven’t been home since 2012 so we’re very excited. Also, do you think we need a lawyer to do the I-485 applications?

Why was it mailed? I always personally picked up my medicals, start to finish it would take up to 5 days. Likely just the bloodwork and flu shot, but some vaccines are also periodic. I had to get tetanus shot, since it expires every 10 years.

Some people get stuck with pending background check status. It happens to maybe 10% of cases I think, so hopefully you'll be able to avoid that.

I know some officers will be picky and if you're leaving a section blank you need to put "N/A" in it, otherwise they might think you just forgot to fill it out.

Do you have C31 EAD? That should serve pretty much same purpose as I360 approval. Although I do not actually know the process of applying for I485 after I360 approval that well, maybe someone will elaborate. I do not think you need a lawyer for I485, it's I360 that required a lot of evidence and stuff, I485 is much easier.

No need to wait for the approval notice to file your I-485,  you can sent it with a copy of your I-360 receipt you can also include photo of your  EAD c31 and all the others requirements, You can also submit I-485 on your own just read all the instruction.

Hi all, 

Does anyone know where to find information about 5 years waiting period to sponsor new spouse since we get green card through VAWA? Three years after getting citizenship from green card issue, can't we sponsor for new spouse  being a citizen instead of waiting for two  more years?

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

INA 204(a)(2)(A). AFM Chapter 21.3(a)(2)(M): https://www.uscis.gov/sites/default/files/document/policy-manual-afm/afm21-external.pdf (As far as I can tell the policy manual hasn't superseded this guidance so adjudicator field manual remains controlling in this regard.) and finally I-130 instructions have the simplest set of guidelines: https://www.uscis.gov/sites/default/files/document/forms/i-130instr.pdf

 

Anyways, to give you the run-down, you cannot petition for a new spouse unless (any of the following):

1. You've been an LPR for at least 5 years

2. You've naturalized and are now a USC

3. Your prior marriage was terminated by death

4. You prove by "clear and convincing evidence" (>75% threshold of evidence) that you entered the prior marriage in good faith.

 

So you've got 3 options:

1. You could file as soon as you're an LPR and include any and all evidence that your last marriage was legit (this might be more than what you needed for your VAWA since that generally only requires "preponderance of evidence" (>50% threshold of evidence)).

2. You wait 5 years

3. You naturalize

 

tl;dr: Yes you can naturalize instead of waiting 5 years and cut 2 years out of the waiting time.
