I have a dilemma and did not find anything useful online.

My AP is outside of normal processing times and EAD is months away according to their new estimate. Should I inquire about AP to nudge the case or I will risk just getting just the AP, not the combo card? Which form is corresponding to the combo card AD or EAD?

Some relevant details:

7/24/2020 Initial filing I-360, I-485, I-765 and I-131. VSC, local Philly

11/30/2020 Biometrics for I-465 and I-765 only. No mention of I-131 which is still at case received online.

1/13/2021 lawyer tried to expedite EAD/AP

2/11/2021 USCIS replied that the case will be processed as normal. I have a feeling that he did not include any evidence (I might be wrong) and it's not relevant any more so there is no need to fight with him or resubmit.

Don't want to poke the lion but it's been 7 months since filing and to think that I might need another 4 for the initial EAD is making me want to cry. Still, my case was pulled once in January and I don't want to make things worse.

Any advice is appreciated. Thanks!

yeah send the online inquire about AP. I recently received paper based AP which is fine.

Hi. I have a quick question. I got my greencard thru VAWA and I am due to apply for my citizenship next month, I am currently in a relationship for 2 years now with my partner.. We are planning to get married soon, if we get married before I apply for citizenship, will it affect my application? Will he be in trouble since I have to put his name in the application form? Or its better that we wait til I get my citizenship, but I dont want them to think that we only got married because I got my citizenship..

I do not think getting married will affect your petition in any way if you're sure you've found the right one, by all means go ahead and tie the knot congratulations!🎊🎉🍻😊

Good things: I been to my appointment today. Was able to verify USCIS has my correct address, yay. and also agent was able to provide me case number of I-131. but thats it, 

 

May be bad:  I checked my I-131 status and it says "correspondence received, and case is being reviewed" not sure what they mean by that. 

 

bad or possibly worst thing: 

 

1. Agent told me USCIS sent me something for my I-360, in October 2020 which i never received. Later she said they sent me mail stating my case is in pending. I am not sure what kind of mail is that or why they sent it. 

 

2. I asked her if i missed my Bio, she said she cant see in system if we sent any bio, 

 

definitely worst thing: 3. Just today morning before my appointment my I-360 status updated to RFE issued. I did not checked my email before meeting so was not able to ask agent about it. I applied for I-360 in  May 2020, received GM RFE in same month, responded in June 2020, never heard back until now. 

 

I am really worried because i went insane requesting USCIS to update my address, sent two mail, congressmen and Senator request and not Info pass, i am not sure if i upset this agent who is handling my case. I have never seen anyone receiving two RFE's in less than 8 months apart. Specially when USCIS already slammed with lot of work and already posted delayed processing timing just two days back. I dont even have much proof's with me and not sure what they need within 7 months. I never received Bio, 

 

Please help if you guys have seen any similar these cases before. @sandranj  @ValeryK, @justmarriedusciti, @Ana FL  @Engineering-rocks also VAWA family, please help, I am really stressed right now. 

 

 

There's really no bad news here RFEs can be sent as needed by the officer anytime before a decision is made.. someone here got up to 5 RFEs how's that? So yeah 2 is nothing let us know what they're asking when you get a hold of it you'll be fine!😊👍

Thank you so much @Stillwinning!!!😊 is it that those who receive more RFE's are in danger zone? 5 wow, did those guys with multiple RFE received approval?

 

Ever since i get US visa, i always received RFE, not a single instance i reached out to USCIS and never received and RFE, not sure if i am on surveillance or something for some reason. 1. RFE when i applied for visa, got approved in 30 days. 2. when i applied for COS within US, approved in 8 months, 3. when i applied for OPT after graduation, approved in 9 months, 4. Even when i applied for STEM OPT I received exact same RFE i received for my OPT. approved in 3 months. and now two RFE's with my WAVA and i am not even half way through. 

 

Thanks, I will let you know you experts what RFE they send me once i will get it.

im sept 2019 filer, after that guy who just got approved whose pd is aug 2019,

i just have this feeling my approval is coming soon.

 

i also have a reasoning,  is there a pre-review done by the officers in about 2-10months inorder to issue rfe

i mean most rfe i see are usually within 2-10 months. does it mean the officers starts reviewing our files  within those time frame and when there is no reason for rfe, it is pre-approved already? and placed in  a queue  for approval within 18-22months,

does it mean if you dont have any rfe within those 2-9 months,  means its a good sign that you have scaled the rfe phase, and heading for approval?

 

gurus in the house..what do you think

They're looking for the information that enables them to approve you. :)

This is a good sign -- it means that your folder is still on an agent's desk and not gathering dust in a storeroom or a warehouse.  Have faith!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hey VJ family, @sandranj, @DemiseI received today 25 Feb 2021 a decision of my i130 citing 204(c) bar. Is it gonna affect my i360?

Went for i130 interview with spouse November 2018. Divorce finalised July 2019( I filed for divorce because the abuse was too much) . Filed vawa October 2019 (pending).  What should do in this case? I'm just freaking out now

204(c) is marriage fraud. USCIS might RFE you for bona fides of this marriage (and any prior ones if you had prior I-130s). You will give them everything you can and you'll be fine.

 

I had that happen with my I-360, but that's because I was in removal proceedings, so immediately they presume that any marriage I enter into is fraudulent. I gave them everything I could and they finally approved my I-360.

Yes received USCIS RFE after the interview and replied to i130 RFE 26 November 2018. The decision just came in 2021 February after I filed vawa already, that I am bared from seeking any future relative petition. And they asked me to appeal at the board within 30 days. So since I am no more seeking benefits under i130 , should I file for the appeal? And what will happen to my i360 based on this decision? @sandranj

No just ignore the I-130 and focus on the VAWA. As I said, they might ask questions regarding the VAWA, but with evidence and a good cover letter you can overcome the RFE. In my cover letter I had to basically take apart and debunk all of their points by pointing them to current and previous evidence.

 

You also can't appeal the I-130, only the petitioner (i.e. your ex) could but you're divorced now anyways so he can't even if he wanted to.
