Timeline

I would like a lawyer to help me as I have become overwhelmed with my case. I have both i360 and I 130 approved and last notice was that they will request a medical. 1 year ago... My daughter have 130 approved through vawa I’m to send in her i485 so that’s where I’m at now and need help. I don’t know if I send her i485 to vawa or the regular office.... @Stillwinning!!!😊

Don’t worry yours will arrive soon: here’s my timeline 

july 11-2019 Uscis received my I-360 package 

july 23-2019 Uscis waived the filling fee

PD on receipt August 6-2019

sept 9-2019 Uscis sent me RFE for police clearance 

December 9-2019 Uscis received my RFE

after that silence 

Feburuary 24-2021 new card is been produced 

no prima fa.

 I can not believe I saw  this day.

No news from congressman office, the person who was handling immigration case quits and the new person was not helpful to me. So i just submitted my address change to NBC anyway without waiting for feedback.

Yes I saw that too and I was frustrated. But surprisingly they are approving cases dated after march 2019. I don't know how what order they process cases but the fact that we didn't get rfe is a good sign in my opinion. Hopefully everything goes smooth and we get approved before our 2 year anniversary. Keep up the faith my dear. Talk to you soon.

Maybe your lawyer doesn't know much about it. My lawyer told me for 2 years now I wasn't eligible for travel document. I did the research myself and told her I wanted to file. She insisted that it wasn't possible because my Vawa is still pending. her supervisor told her so. I told her no the i731 is related to the i485. it wasn't until 2 weeks ago that she filed the paperwork not without telling me it won't be approved for a long time. sometimes lawyers don't know all the possibilities we have with Uscis. but in you case it is possible to put the old i485 on hold after you filed your i360. that way you don't lose your pd.

Why was his case denied? Because he forgot to show the officer his approved I-360?

I am getting so many different pieces of advice. Some are saying file a new concurrent I-360 and I-485, and some are saying file I-360 and ask USCIS officer in writing and during interview to hold I-485. Not sure which is the best way forward, but for sure I have to use attorney so they can talk directly with USCIS if needed. One more thing I want to ask, how long is it taking nowdays for I-360 VAWA to typically be approved? I have a strong evidence of abuse.

no, there was another issue. That person travelled outside and return using their student visa instead of advanced parole. They just have to refile 485 again. It was interview after Approved 360. Not the marriage based one.

If your 485 still pending (make sure it is pending!!!), when file 360 also include a letter asking to link your current 485 to your i-360. They process these letters for a long time, so you can still expect them to schedule your marriage based interview. This happened to ValeryK.

So we went to her interview with a copy of her 360 receipt. They didn't even have her documents in the office already lol. Her 485 already got sent to Vermont, but noone communicated it with the scheduling department. So she just showed her 360 receipt to the officer and asked to hold 485 in abeyance. It is just important to show up, otherwise they will deny that 485 with the reason "did not appear for interview".

The sign that your 485 got linked to 360 is usually it being transferred to VSC from your local office.

it is definitely better to keep your current ead and be able to renew it, than filing for a new one. I just got mine after over 5 months of wait, and ValeryK just got hers that she filed in July, so 7 months! with the renewal you at least get 180 days extension on your receipt

Yes! but if you file your second I-485 together with your I-360 package you don’t have to show the officer your vawa approval notice, VSC will automatically send your I-485  with your vawa approval package to your local office, so when you go to your GC interview the officer already have your vawa package in front of him, you are approved!! Congratulations

You are just talking about someone else that’s a different case.

Maybe, you just mentioned recently, and I remembered that case. She panicked at first and we all though maybe it was because officer didn't see it was linked to 360, but then she got her denial notice and it was the reason I mentioned above.

 

you mentioned their 360 was already approved. It couldn't be the marriage based interview then, right? 360 approval takes about 2 years
