my divorce still in process. i guess your attorney wants to make additional money by filling out i-485 second time.

I am sure that is the case. If USCIS doesn't have a problem for sure, then my attorney shouldn't say that they will have a problem.

What is it technically mean to "hold I-485"? Does the USCIS officer understand that we are trying to say that we need it converted from existing I-130 to I-360 VAWA now? It doesn't mean that I-485 processing is to be stopped, right?

My spouse hasn't withdrawn it yet. and I will get in touch with congressman's office too. I'm still searching for any official USCIS guidance on being able to use old I-485. Is there anything on their website I can read up?

Half of the people on this forum used their old marriage-based I485 for their VAWA.

yeah they will understand what you are saying. Just show them i-360 receipt notice and they will hold that. the processing of i-485 will stop until i-360 get approved or rejected.

in addition to that there is a link from the USCIS website that state that you can request to USCIS officer to hold your i-485

That is good news. I don't want to lose my current job and for that I need to hold on to my EAD that I have from I-130+I-485 concurrent fiiling.

Hey Guys, here is an update and couple of questions, i am really paranoid.

Valery, I received Info pass to update my address tomorrow. So yes, they are still giving info pass appointments,

360:May 2020,

RFE: Good moral in May 2020, responded in same month, received status update in June,

485/765/131: November 2020.

I never received any Bio request, I am going to update my address with info pass tomorrow,

1. Can i ask at info pass center if they ever sent me Bio request as usually status update dosnt reflect that?

2. What if i will miss my Bio? I have all record or communication i sent update my address, will that help to defend my case?

3. Can i also submit my I-131 as they only allow to submit my I-131 if it is emergency, issue is i never received receipt of my I-131. Can i ask them to print it for me?

4. What is up with this bio? I saw some people got it some dont, why is like that?

TIA, @sandranj @Stillwinning!!!😊 @anaFL, @ValeryK big thanks to you guys for helping us in need.

Just seeing this.. great thing you secured an appointment! Please feel free to take maximum advantage by asking all the questions you need closure on.. you can write them all down so you dont forget!  i131 is your advance parole.. I believe it doesnt need to be an emergency for it to be issued.. it's a benefit of i485 pending petition.. it is only expedited when there's an emergency backed by supporting documents!👍

Guys i know it might be too early for me to panic.

But i am just wondering my Vawa is pending for last 14 months. I did not get any RFE or anything.

Any suggestions?

Best not to get any RFE.. this situation delays the entire process! 14 months is not enough time to start panicking some waited up to 23 months and more keep calm and trust God!👍

The process to detach and attach I-485 form to petition I-360 is called INTERFILING and is well recognized.

Hi all,

Some members here mentioned that I can file VAWA I-360, get its receipt number before my I-485/I-130 interview and provide it to the USCIS officer at the interview. I spoke with two different attorneys and they said that I have to file both I-485 and I-360 concurrently. They said I can't use existing I-485 and file I-360 using that since my divorce has been filed and once divorce decree is finalized, that I-485 will be null and void. I'm wondering if that's the case and I can't use existing I-485 and have it converted to I-360 from the already filed I-130?? This attorney I contacted is a very reputable one in Washington DC.

What is good about forgetting your marriage based I-485 and file a new I-485  with I-360 is, your spouse can not use your I-485 marriage based receipt and track your case, other than that is not a bad idea to put it on hold and yes you can ask the officer to put it on hold if you have your vawa filling receipt. If I were you I wil just void the marriage based I-485.

Tbh, I don't think it is a good idea to file another I-485. My lawyer did and I had two pending I-485s. At the interview, the officer was complaining a little that he now has extra work and has to deny one of them.

To be on the safe side, filling another I-485  is good because we have seen a case of someone here who depended on his only marriage based I-485 and got his case denied at his interview  even though his vawa has been approved and forgot to show his vawa approval notice to the officer, if like to say he filled  another I-485 together with his I-360 he would have never got denied.

Any update yet my dear? Did you hear back fro your congressman office?

Hey, no update. I saw that processing time for I360 at VSC as dropped for the 3rd time from end of March 2019 to beginning of it. That is frustrating...
No news from congressman office, the person who was handling immigration case quits and the new person was not helpful to me. So i just submitted my address change to NBC anyway without waiting for feedback.
