My I360 still pending I filled it on September 2019 ! I’m also in removal processing ... I believe  I have chance to apply 485 in court Instead of uscis!! My question is do I need to submit it or once I got  approval  first termination and submit 485 to uscis ? Now time is coming stress also coming ! thoughts are never go away so I’m really deeply thinking !thank you any advice

Just Google who your state senator/s are and pick one. Then Google for that Senators website. Their contact details should be on their website. The senator I contacted also had immigration inquiries section on their website. I sent a request via their website immigration inquiry section with a summary of my case and a privacy release form that they required. My senators office has always been very responsive. Your mileage may vary.

From hat I know first your I-360 has to be approved for you to submit the I-485. But I can be wrong have you a played for a I-485 already?

Actually here some members already submitted their 485 form to court  they already got accepted ..! I didn’t  do anything with 485! It is just in my mind and thinking what should I do?

I am in immigration proceedings too. Have pending i-360 since October 2019. I submitted my i-485 at USCIS irving TX last month and was accepted and received and both uscis and court sent me i-797 receipt notices. Once my 360 get approved, i can continue with uscis and my i485 will be on the queue already. This will save time to get my green card

@sandranj hi there. I have a question based I. Your previous comment. If someone applied for asylum in the past and now have AP they can’t travel ? If yes how can they overcome that and be able to travel ?. Thank you in advance.

You cant travel to your home country if you are applying based on asylum. It defeats the purpose. Other than that you can travel the world.

You can travel on AP, but you should not travel to the country you're claiming persecution from because it makes it look like you made a bs asylum claim (this extends pretty much until you naturalize). Travel to anywhere else should be fine, but considering the pandemic, and the fact that AP doesn't really save you from any entry bans due to the pandemic like Brazil, Schengen Zone, etc, I would hold off on international travel for the time being.

I mean you can do it one of two ways.

You can file I-485 with the court which will generally lead to the court granting you continuances until the I-360 is approved, or you can try and get the proceedings terminated and file I-485 with USCIS. In the unlikely event that the court would terminate proceedings after you filed I-485 with the court you'd take the termination order, the receipts from the court and USCIS that you filed with the court, and refile I-485 with USCIS without paying the fee again.

If you travel to your country that you are claiming  prosecution and you are saying to immigration that you will be harmed and that’s why you want to claim asylum your asylum flame will be denied

Thank you. Just for clarification I’m not doing my AOS based on asylum. I was just curious because the person who made the comment said if you did asylum or you are in removal proceedings you shouldn’t travel. Therefore I was wondering if it should be for all international flights in general that one should avoid traveling or to have more clarification on the subject.

Thank you for your comment. I’m not doing my AOS based on asylum. I was wondering if one should avoid traveling at all.
