She can't sponsor a new spouse until at least 5 years passed since she gained residence, It's the Law, and the  law was enacted in 1990.

She can try to sponsor him but if USCIS denies the AOS he will be removed from the U.S.  She can  overcome the 5 years rule if she can prove that se had  ALL the documents mentioned below with her  FIRST  husband.

Documentation showing joint ownership of property

Joint lease or documentation showing a common residence

Documentation showing commingling of financial resources

Birth certificates of any children born of the marriage

Affidavits of third parties having personal knowledge of the marriage who can attest to the genuine nature of the couple’s relationship.

Hello Sandra! Would they take into consideration the fact that are you being separated from your first husband for so many years?

Like In my case: not with my husband since 2016. Waiting form my vawa approval since 2018. This law seems so mean. 😑😭

1. Maybe try to get FBI? Mine took under a month (pre-pandemic). It will work for all the states.

2. Yes A number stays the same forever like SSN.

3. Not sure but I am guessing yes.

4. Not sure but I am guessing no. Ask lawyers about that.

Thank You so much .

I’m confused here. Is this rule for VAWA based GC holders or for those that got their GC via marriage and later divorced?

The rule is for anyone who obtained their GC based on marriage.  VAWA is a category based on marriage.  You cannot apply for VAWA if you are not married to a US Citizen or LPR.

@Stillwinning!!!😊 @sandranj And ho else  can help.

I received the RFE to do my son's medical exams in August 2020. (he is 4 years old) but it seems that he also needs a medical exam and I will do it tomorrow.

I've checked with my Congressmen and my case has been in the Local Office since September 2020.

My question is whether I can send this exam to my Local office or can I send it to Vermont?

To see if the date of the interview is speeded up.

I thank you for your time and attention to us all.❤️

You sent it to where it says on the RFE.

Thank you!
I reached out to my congresswoman and got reply within 30 minutes, she sent me exact interview date, time and location! So relieved now!

She didn't send me full letter though, so I can't see which supporting documents should I bring to the interview, would anyone please share their experience for the required documentation?

Also, it wouldn't be an issue if I just show them interview notice letter on my phone once I show up there, would it?

You could do this as an alternative but first try so ask your congresswoman to request a copy from USCIS they'll send it real quick..hopefully!😊 Attend your interview with all your important documents marriage certificate, divorce certificate, birth certificate, EAD card, driver's license/State I.D, international passport document, your medicals, tax documents and employment verification letter!👍

Dear friends

As I mentioned in my previous post that I had  saw such a tough time I am here in USA for the last 7 years and I never travelled back to my home country first in the month of November 2020 my sister passed away and then with 17 days time my father passed away Ie December 2020 and since my parole is pending I didn’t travel to my country.

Further to add here that  my  VAWA is already approved I got the RFE for I-693  Ie for Medical 2 days before so hopefully when I submitted the same the USCIS will approve the green  card without interview.

so I have a question that since my attorney is preparing the form I-693 so her name will be there in the column that she is the prepares and then the civil surgeon will sign the same and give me the seal copy so that I can submit it to the USCIS field office.

We need more approvals, so here is another joke:

SQUIRRELS IN THE CHURCH

The Presbyterian church called a meeting to decide what to do about their squirrel infestation.  After much prayer and consideration, they concluded that the squirrels were predestined to be there, and that they should not interfere with God's will.

At the Baptist church, the squirrels had taken an interest in the baptistry.  The deacons met and decided to put a water-slide in the baptistry and let the squirrels drown themselves.  The squirrels liked the slide and, unfortunately, knew instinctively how to swim, so twice as many squirrels showed up the next week.

The Lutheran church decided that they were not in a position to harm any of God's creatures, so they humanely trapped their squirrels and set them free near the Baptist church.  Two weeks later, the squirrels were back when the Baptists took down their water-slide.

The Episcopalians tried a much more unique path.  They set out pans of whiskey around their church in an effort to kill the squirrels with alcohol poisoning.  They sadly learned how much damage a band of drunk squirrels can do.

But the Catholic church came up with an even more creative strategy -- they baptized all the squirrels and made them members of the church.  Now they see them only at Christmas and Easter.

Not much was heard from the Jewish synagogue.  They took the first squirrel and circumcised him.  They haven't seen a squirrel since.

I'm catholic and they sure do see me only on christmas and maybe easter lol and that is not something to be proud of lol
