Hello Everyone, I got my Green Card through Vawa in July 2020. 
 

does anyone know if I can remarry and sponsor for my spouse ? I have heard about 5 years rule. Has anyone here sponsored for their spouse after getting Green card through Vawa

As a green card holder you can sponsor your kid or your spouse so yes! And you definitely can remarry!👍

That is true.  A GC holder that has obtained their GC through marriage based GC visas will have to wait for 5 years to sponsor a new spouse after a divorce.

You did not get your GC through marriage but by self petition! I hope the confusion is cleared up soon as this is just my perception! The IO who interviewed me didnt say I had to wait 5yrs..💁

Today I received a notice that We denied your for I-130 and we denied your I-485.

I'm really sorry for you?. Did you receive the reason of the denial?. Do you have any criminal record?.

Thank you for the response . I haven't received any notice yet . I hope I will get it within a week . And, I do not have any criminal record I believe . I never had any public charge , arrest or warrant. So far I had 3 traffic violation tickets that I already paid for . Is there any chance  USCIS will reject approved I-360 because of they denied I-485 ?  And I am wondering if I should refile another I-485 and separately appeal to reopen the existing case  when I will get the denial letter . I don't know if anybody has ever done that before ?

The only time USCIS will cancel an already approved i360 is if they find new evidence that wasn't available at the time of adjudication! I believe your case will be rectified once the mix-up is identified!👍

Did you file more than one I-485 or hold I-485? It reads as if your I-485 that was connected to your I-130 was denied.  As they have denied the I-130.  It is a big mess if they did not hold your I-485 based on VAWA.  The good thing is you can always re-apply for I-485 or file a motion to re-open.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I sent letter with a receipt copy  of I-360 to the field office to hold I-485 which was connected to I-130 . I did not make more than one I-485. I agree . that's a good thing .  that's also another lengthy process . I am gonna share the denial notice as soon as In get that in my mail. Waiting on that . Thank you for the response .

Has anyone sent additional documents to USCIS? I am contemplating sending additional 6 months worth of therapy (PTSD treatment) + 1 additional month of another therapist, divorce documents (once I receive the final judgement), and tax documents. I filed Sept. 2020.

 

Please let me know.
