Yeah, while in removal proceedings you'll basically file just the I-485 with no evidence (just the I-485, G-28 (if applicable), and a check/money order/G-1145 for filing fee, or if the IJ granted you a fee waiver a copy of the order instead) with a special lockbox in Irving, TX. USCIS will issue you a receipt notice which you will attach with the court filing (which is basically an I-485 packet) just as a proof that you filed with USCIS and paid the fee is applicable.

Then you can file for a C9 EAD with USCIS using the aforementioned receipt notice and proof that you filed with the court (e.g. a stamped cover page of the package).

If the IJ approves your I-485 you will get a court order granting you AOS, you will wait a few days, schedule an infopass appointment, bring the receipt notice and the IJ's order, and USCIS will print your green card.

So does this mean your case has to be adjudicated by the judge and the judge only, after 360 approval?  You can't transfer to USCIS for adjustment?

Hello Guys, asking for a friend.

She got married to US citizen in September 2020. Things are not going smooth and there is too much abuse including physical. She is going to file VAWA soon.

Q. Fortunately, they sent there whole package (485, 131,765, 944, 693, 864) already, she havent received biometric appointment yet. But if she will file VAWA, and will request to USCIS to hold her 485, what she need to do with her I-131, and 765? She need to send new I131 and 765 or she can use the one they will approve?

What if USCIS approve her I-131 and I765 prior her filing VAWA? Can she use it to travel her home country?

@Stillwinning!!!😊

@sandranj Please help.

thank you,

The advance parole and employment authorization will be valid as long as the I-485 is not denied. She should be ok to travel as long as she doesn’t have asylum case. Double check her country situation regard covid.
if they hold her I-485. tell her to write a letter with a safe address so that any future correspondence goes to her safe address.
