I wanted to share that after spending a good month abroad, I returned to the states with no issues, traveling with advance parole while waiting for green card adjudication. I did go through the "little room" where they verify the advance parole. I had a nice talk with the CBP officer, who even asked me why was my green card taking so long. He admitted that this status of pending/waiting for green card was kind of a limbo. The officer did warn me that even if we were able to travel anytime we wanted while our advance parole was valid, they were currently revoking the advance parole to any person traveling to the countries currently banned for travel due to covid 19. Example: Brasil. He said "wherever you go, do not travel to brasil, because when returning to the states, we will revoke your advance parole and send you back to your country". So I though of sharing this piece of information to whoever is having travel plans.

 

 

Yeah my friend just got back from Brazil last week and she was taken to the “little room” too. Her 2 year green card expired and she is waiting for the permanent one. (She has the extension letter but the actual green card is expired) 
She said it took them almost 3 hours to clear her to get in and they told her that if she didn’t have her green card, only advance parole things would go much different for her. 

08/2017 - Married USC

09/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

09/2018 Renewal application for I-765, I-131

04/2019 - I-485 interview scheduled 

04/2019 - I-485 denied, husband withdrew

05/2019 - Application for  I-360, I-485, I-765, I-131 

12/2019 EAD, AP approval

07/2020 EAD, AP renewal sent to Vermont

10/2020 EAD, AP Approval

11/2020 VAWA I-360 Approved (C31 produced)

01/2021 I-360 status changed to case approved

03/2021 - I-693 deficient notice from national benefit center

Actually after speaking with @sandranj, she said you can file your i485 with Vermont concurrently with i360 even if you are in immigration proceedings. Vermont is the only place where all i485 and i360 must go. since i sent my i485 to uscis Irving Texas last November 2020, i can only use it if I want a judge to decide on my case in court. If i want uscis to adjudicate my i485 i will have to file a new i485 with Vermont and pay the fee for the second time. I should have sent my i485 to Vermont initially. My i360 is pending since October 2019

Hi. i got second prima facie and valid 6 month. its different than first ( first was valid one year) on second prima facie is writing  " the request for an extension  of a prima facie  case for classification under-petitioning  provisions of the Violence  Against Woman Act has been reviewed and granted" my question is ' did they granted my prima facie the letter its means right? and has reviewed means will i be granted? I don't know, are they working on my case and because was reviewed? is it good second prima facie for my case?

Hi MariaX,  it looks like standard wording for the second Prima Facie. I got my second prima facie last week with the same wording, and its also valid for 6 months. And yes, looks like your second prima facie was granted.

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

You are welcome. I sent I360 in 11/2019. And then I485 plus I765 (EAD) and I131 (Advance parole) petitions in 2/2020.

I think you can file another I-485  package with another waiver and send it to Vermont, attache your I-360 receipt, I have a feeling that you will be ok.

TIMELINE:

2014 - Filed for asylum, got denial after interview, did not appeal due to active F1 visa.

Oct 2016 - Married to USC

December 2016 - Marriage package filed

August 2017 - Traveled to home country with AP due to family emergency

October 2017 - Filed for divorce, got order of protection

December 2017 - Filed for VAWA, due to bad advice submitted a new I485. Marriage case stayed open after a request to reschedule interview.

Bunch of PFs and EADs here, EAD would usually take about 3-4 months.

August 2019 - RFE for GMC due to a trip to Ukraine with AP. It said something like "if you lived in a foreign country more than 6 months in the past x years". Submitted proof of only traveling for 2 weeks and FBI clearance.

December 2019 - Contacted congressman and ombudsman since case was a few months past the processing times and 90+ days since they received response for RFE.

January 2020 - VAWA Approved status online

February 2020 - C31 EAD

March 2020 - VAWA approval notice

April 2020 - Notice from NBC about medicals

Evidently at NBC my marriage case resurfaced and my VAWA case was sent to a wrong state to my marriage case address as per congressman. Multiple requests to transfer from NY to TX through congressman, info pass and in the end ombudsman too.

November 2020 - NY sent my case to TX

December 2020 - Interview notice for January

I brought a huge binder with me for any possible questions they could ask, mostly related to proof of marriage, divorce, medicals, financials - proof of employment, paystubs, taxes etc.

Jan 2021 - Interview ❤️

 

INTERVIEW

It was in Houston field office, I came in about 20 min before interview time, waited for 30 min. My officer was extremely nice, his last name was Moreno or something like that. I told him I was a bit nervous and he said "don't worry, no denial for you, worst case is you will get RFE". I had my lawyer on the phone, she charged me hourly rate for this, so wasn't much money to invite her, and I did it just in case I got an officer who'd go off topic with marriage/abuse/asylum questions, she said she could stop such line of questioning. He only went through questions from I485 form. We updated things like address, employment, yes to worked without permit, yes to citations and a few others. I gave him proof of divorce, paystubs, 2019 taxes, proof of employment, medicals. The interview was about 30 min, in the end he said he needs to do background check and it takes about 3 weeks, and then I will either get gc in the mail or get rfe/noid in case they are missing something. Later that day I got Card Being Produced update, so I guess he skipped the background check. Next WD I got an update Case was Approved. So now I'm just waiting for tracking number and to get it in the mail.
