I applied for VAWA 2 years ago, I applied for all the important stuff together likw I 485, I 360, I 765 etc. ( Ok, fine  my lawyer applied )

I received my Prima Facie, I received EAD, I actually had to apply for another EAD because it expired, the new EAD is good till 08/2021.

In November 2020 I replied for the  request for additional evidence RFE and waited... and waited.

I just checked my I 360 status and it said

"On February 12, 2021, the Post Office delivered your new card for Receipt Number EAC***, to the address that you gave us. "

So ... what does it mean? What NEW CARD did I receive? I didn't apply for the new EAD card, I didn't go for the I 485 interview?

My lawyers office is closed till Tuesday and I just can't sleep without knowing! 

Did anybody else received something like that?

Yes, sure! 

It was regarding my good moral character.

I submitted criminal clearance from my home country, the state where I live and a letter stating what I bring to society :)

 

To be honest, when I first saw RFE request I was so stressed out, I was worried they wanted more evidence about my marriage and I really didn't want to go thru that again; but once I read the letter I was so relived! Evidence for Good moral character ? hell yeah!

Finally got the courage to file for the divorce. The thing is.. my husband’s (soon to be ex) phone is disconnected and the company I hired to serve him said they tried 3 times and couldn’t find him. There is a good possibility he is out of the country.., can I still get divorced even if he doesn’t sign the papers?? We have been separated since 2019. 

08/2017 - Married USC

09/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

09/2018 Renewal application for I-765, I-131

04/2019 - I-485 interview scheduled 

04/2019 - I-485 denied, husband withdrew

05/2019 - Application for  I-360, I-485, I-765, I-131 

12/2019 EAD, AP approval

07/2020 EAD, AP renewal sent to Vermont

10/2020 EAD, AP Approval

11/2020 VAWA I-360 Approved (C31 produced)

01/2021 I-360 status changed to case approved

03/2021 - I-693 deficient notice from national benefit center

Yeah, there's alternate methods of "serving" the papers to the other party, like by publication in a local paper, taping it to the door at last known address, I know some courts allowed service via facebook or email. You basically need to request a permission from the court since you have no idea where your ex is to do an alternative service, once you get it, you do what the court prescribed, and file for a pretty easy divorce (since he's likely gonna no show).

You will have to do where you have divorce by publication.  You will have to post in the newspaper you are looking for this person to serve and you have to wait based on state laws up to 3 months and wait for no response, and then you can proceed.  

 

Do you have a lawyer?  They know how and where to publish it.

Hi everyone 

maybe it’s a stupid question, I apologize in advance Lol

I need to file for my EAD extension right about now, and I don’t know what to do - to do it under c31 or under c09?
My i485 is pending in Nebraska center, but no updates since 2018. 

If I decide to file under c09, do I have to pay a fee (first time they gave me Ead c09 with no fee while I was still waiting for my interview for i485 marriage-based). So if I file under c09, do I file it to Vermont? How will they know my i485 is pending? Will they know, or I have to mail them a copy of i485 receipt?

or should I just file under c31 and stop overthinking it? 
when I think about all of this, I get overwhelmed, and I just keep delaying filing, but time passes and I will need that EAD soon!

please, if anyone can advise, I would appreciate

Pinkrlion gave you all the right info! 

I was worried I wasn't gonna find my husband too and then yes, I would've have to proof to the court I wasn't able to find him, that I reached all his family members, his friends, work etc, then they would allow for the publication in the news paper, and has to be in the area of his last known address , Im not sure how long you have to publish it for - at least those are the rules here in Los Angeles, I'm sure every state is different.

Try to find him because I believe you would be responsible to pay for the publication in the newspaper...

Lol I can relate! The toughest part is done now and yeah.. another wait for greencard💁 most folks wait past 12months just brace yourself..you're almost there though!😊👍

12 months 😮 holly cow! 

Well I guess I waited 2 years already, I can wait another 10 years haha :D 

The worst part is I didn't apply for Advance Parole so I can't travel now, I don't know if it is worth to apply now anyway - I would probably get it in 3-4 months.

But I'm glad I found this forum so we can complain together and be in this together :)
