@sandranj.   Could you give some input here  ?

You traveled without advance parole then the denial is correct, you need to refile a new one.If you get a notice to appear in Court you must go to the Court.

Sorry to hear that. Before filing a new i-485, try to consult a lawyer who knows immigration laws it may cost u a 100$ consultation fee. It may be a problem that can be resolved with a motivation letter explaining laws in it and showing the immigration officer how vawa applicants are forgiven for these kinds of inadmissibilities using some immigration laws and demonstrating them in that letter.

.She should not write to USCIS asking what you suggested.

Does anyone know whether moving from state to state affects VAWA timeline? Since we sent it all to Vermont. Mine hasn't been approved yet.

It doesn't affect the I-360 timeline.Keep in mind USCIS is very messy and they  rarely update the address.Change your address and after 5/7 days go to info pass to confirm if the address was changed or not.

She should not file a new I485, if her AOS is pending she needs to submit just the I-360 and a copy of her I-485,plus the documents specified on the form I360. They will not inform  by mail if they will hold or not the I-485.She must attend the interview when they schedule ok.

Thank you @sandranj, appreciate your help again, so even she will send I-360 before her interview is schedule, they will still schedule interview for her? Thank you, I will let her know,

Hello everyone,

Congratulations to all approvals.

I got my interview yesterday. Everything went ok. Total probably 20 mins in and out. Everything was smooth just yes no questions. Officer said everything was looking good from his side. Checked my approved I 360. Asked my birth certificate and medical check form. Asked how many times I was married. What year I got here in US, got excited and said 2016 instead of 2015. That was it.

now my receipt number says

“Interview Was Completed And My Case Must Be Reviewed”

is this normal? Is this a good sign? How long will it take to get the gc?

thanks in advance. Congratulations again to new approvals..💃

Hey, I also did not get an answer right away. Had my interview on Jan 27, no updates so far. Let me know if you get any updates! Good luck!

If you're selected for additional background check my IO told me it takes 3 weeks.

Hi Visajourney family.

I360 sent December 2018

I360 approved September 2020

I485 interview notice February 2021

My green card interview is approaching.

It is like $500 to have an attorney with me (is it better to go with an attorney) please 🙏 I'm not currently working, i really can not afford to pay $500.

Ha! You remind me of my case! The attorneys are all about money! It don’t matter if you’re dirt broke, they’re willing to squeeze every penny outta you!

I had a straightforward case but still had worries about going alone for the interview. The atty’s I reached out to said I should carry my checkbook before stepping into their office 😂

I reached out to Sandra who said I should go alone. The atty will only sit next to you for 5-10 mins in your interview. They won’t speak, just be mere spectators lol. And after that you’ll regret spending $500 for nothing!

so my advice is, be confident, gather all required docs. If you need an interpreter, let them know before hand.
Good luck!

when you change your address online after VAWA approval, do you get anything from USCIS, like a notification or something?
my congresswoman said that they noted the address change and will send me date of the interview when it gets available, although I'm still being paranoid about it, as I see how messy they are with the updates and not mailing notices. I also have USPS forwarding my mail from my previous apartment.

As a green card holder you can sponsor your kid or your spouse so yes! And you definitely can remarry!👍

She can't sponsor a new spouse until at least 5 years passed since she gained residence, It's the Law, and the  law was enacted in 1990.

She can try to sponsor him but if USCIS denies the AOS he will be removed from the U.S.  She can  overcome the 5 years rule if she can prove that se had  ALL the documents mentioned below with her  FIRST  husband.

Documentation showing joint ownership of property

Joint lease or documentation showing a common residence

Documentation showing commingling of financial resources

Birth certificates of any children born of the marriage

Affidavits of third parties having personal knowledge of the marriage who can attest to the genuine nature of the couple’s relationship.

Thank you for your response . Yea that's the only thing  I can see as my hope . But it would be really better if I have any option to reopen with any valid ground against the denial notice . Otherwise have to go for the route that you said .

There  is NO ground to reopen your AOS my dear. USCIS denied your I-485 because YOU made the mistake to travel without advance parole.
