@sandranj Hi Sandra, I was reading your posts regarding asylum and got pretty worried. I applied for one in 2013, got interviewed and denied in 2014 (no appeal), maintained my F1 status since then. I did, however, travel to my home country once in 2017 with AP due to close family emergency (which I have documentation for). Now I have an approved VAWA and waiting on interview. Do you have any advice you could give in case this comes up in the interview?

You need to know why your asylum was denied,  if it's specified  that  you had "a frivolous asylum application" then most likely your AOS will de denied. The INA Law §208(d)(6),states  that a frivolous application makes the person permanently ineligible  for any benefit.

Thank you @sandranj !! So along with my application i must add a letter requesting CIS to verify spouse status. Is that correct?

Yes ask USCIS to search about his immigration status, mention  you have knowledge that your ex spouse became a U.S Citizen. You should mention his full name, date and place of birth, name of his parents ,  his alien number if you know the number and/or his social security number as well.

Thank you for your response. It never said anything about frivolous asylum, would that have to be the specific wording they use? NOID had details from the interview where the officer felt like I was inconsistent in my answers, and in the end it says " Considering the identified credibility issues, the absence of reasonable explanations for those issues, and taking into consideration you individual circumstances, your testimony was found not credible under the totality of the circumstances. As your testimony was not credible in material respects, you have failed to meet your burden of establishing that you are a refugee as required by 8 C.F.R. 208.13(a). Consequently, you are ineligible for asylum.". Final denial just referenced NOID reasoning.

I guess the paragraph they quote is different from the one you just mentioned, which is good?

Don't worry you'll be fine I think by end of the day you might have a decision or worst case scenario two, three days alright? Relax.😊👍

@stillwinning

Thank you so much, I’m praying for that.

I don’t know if I overthinking but I realized now that I told the officer two dates that were not accurate 😭😭😭  she asked me from what date I was living in my current address and I said dec 2019 but I send the change of address in March 2019.

She also asked since when I was part of the group of church in my home country and I said around 2014 but the letter I gave them said 2012.

do you think I am in trouble because of those mistakes? 😭🥺

I have a feeling you will be approved in under a week. But please be patient 🙏🏽 To me it looks like your interview went well if you take out interpreter part 👍🏼

Thank you, first God that happens... I think I should have done the interview without the interpreter and it would have been so much better. 🙏🏼

Has anyone responded to RFE with medicals by themselves and mailed them to the USCIS? I have a lawyer to do it, but their office is very slow. So I wonder if I can just do it by myself. In the RFE, I think it only mentioned to mail USCIS a copy of the RFE and the I-693(medicals). But I am not sure exactly. Is there anyone in the same situation?

Hey dear just try to relax a little bit I think the most that will happen is the officer will update the the previous information to the mistakes you made today obviously due to anxiety..just relax I don't think this is enough to disqualify you or anything like that..👍

Hey there. Medicals RFE is as straightforward as it gets. Just do the medicals, put a SEALED envelope with medicals along with a copy of your RFE notice and send it to the address they provide. Fingers crossed you will be approved with no interview.

So many have done this and from recent trends, it might land you an approval sans interview! Also I believe the address above is your field office! You can easily do it yourself without involving the slow office attorney it's so easy do-it-yourself send it out hopefully good news in a bit!😊👍

@Engineering-rocks  @Stillwinning!!!😊 Thank you!!! When I mail them to the USCIS, do I have to include the USCIS officer's name in the address? Or just put the USCIS's address(without a specific person's name) is fine?

So I did it they provide me with the priority mail label and tracking

I sent: enclose envelope medicals, notification of the medicals.

That is it!

The instruction says to the address not the officer who's directing you to send it okay it's pretty straightforward you have nothing to worry about you'll be fine!😊👍
