Hi, 

 

I would be very grateful for thoughts on below questions on the I-944 form. Sorry for the long list. 

 

1. Part 2 page 2 and question 1 - where I mentioned myself and then it asks two questions (a) Does this individual live with you? (I ticked YES box - would this be correct?)

(b) Is this individual filing an application for immigrant benefit with you or has this individual already filed an application? (I ticked NO box - would this be correct?) 

 

I answered in the exact same manner for my spouse - first yes and then other question no - is this ok? 

 

I am not sure what the purpose of question (b) is? USCIS instructions do not make this clear. 

 

2. Part 3 page 3 and question 1 - as I just arrived in USA and have not filed federal taxes, how do I answer question for myself - Did you or your household member, whose income is being included, file a Federal Tax Return? I think that I need to answer YES because my spouse has filed a federal tax return. Do you agree?

 

And then when it says about the reason you or your household member did not file, I can tick the box "Not required to file a tax return", correct? When it asks for an explanation I could type in " Since X date I have worked and lived in UK. Please see enclosed most recent tax return from UK". 

 

What do you think? Would this be a good answer? 

 

3. For Part 3, page 6 and question 10 about Liabilities/Debts - are these only my debts and liabilities or also needs to include my spouse's liabilities/debts? I think that the question says only mine and does not mention household. Also USCIS instructions does not mention households liabilities/debts. 

 

4. For the health insurance questions - I am a dependent on my husband's health insurance plan. This is a stupid question, but USCIS would treat this as me having a medical health insurance, right? I don't see a reason why not, but just wanted to double check with you guys here.

If you are a USC then no matter WHERE in the world you live, you are required to FILE a US tax return every year. I said "FILE" because it is very likely you would not OWE any taxes to the US (FEIE = Foreign Earn Income Exclusion) on up to approx. $100k of earnings BUT you are still obligated to FILE. This is spelled out clearly on the last page of your US passport....
