After 7 months of being stuck at the NVC, our case is finally in "Ready" status at the embassy! I am the American petitioner. Regarding income requirements, I filed my tax returns back in July but my transcripts are still not available. I've called the IRS multiple times and they told me not to refile and they're still working through the backlog of mail. If her interview comes up and I'm still in this position, can I substitute an explanation, 1040, letter of non-filling, and an IRS wage & earning (W2/1099) transcript at her K-1 interview?

We haven't gotten them yet. The status just went Ready yesterday. Were trying to be prepared, and I'm getting ready to send her a parcel of additional documentation that she may need (printed photos, more evidence, the letter that we need to present since the petition expired, etc.). It can take a few weeks to get parcels to her country, so I'm sending it Monday. She doesn't have a printer, so if I need to include something, I'm trying to get a jump on it.

For interview instructions use the "visa" tab at your embassy's website. Then scroll down and choose "fiancé" which will take you to the procedural page where you will find the link that will take you to the instructions on USCIS's website where you can see all the requirements. I usually have the P3 letter that embassies send to the beneficiary to prepare for the interview, but I don't have one for your country. If I did, I would share it with you.

 

Everything that she will need for the interview you can complete on your end and email to her for her to print in her country. Extra evidence is not needed for the interview. The CO has their mind made up and the interview shouldn't take any longer than 5 to 10 min hardly enough time to go through someone's picture album. Keep it simple you are not processing through a difficult embassy.

 

If you still do not have a TT than provide a Form 1040 U.S. Individual Income Tax Return for the interview. Here is what is needed for most interviews.

 

EVIDENCE OF SUPPORT: You must submit any evidence which will show that you and members of your family who will accompany you are not likely to become public charges while in the United States. Visa petitioner (US Citizen) will have to complete form I-134. If the petitioner does not qualify as a sponsor, a Joint-Sponsor should present (any US Citizen living in the US or Legal Permanent Resident), who will also have to complete form I-134. Both the Sponsor (Petitioner) as well as the Joint-Sponsor, will have to present last year's income tax return transcripts. W2 form and proof of current and sustainable income (e.g., letter of employment on letterhead including salary and start date, most recent salary receipts, bank accounts, the value of properties, etc.). You may download the I-134 affidavit at https://www.uscis.gov/i-134. Bank statements in place of a letter from the bank will work fine. Print the statement that shows the opening balance for a month and the closing balance for that month. Do that for 12 months—no need to print off all pages of a bank statement.

I see on their website that they are not processing K-`1's. I'm wondering why you have a "ready" condition, but the embassy states they aren't processing visa except for a select class of visa's which the K-1 is not list as one. Simply curious. Good luck and stay engaged.

Most embassies are requiring the Tax Transcript from the IRS as they are less likely to be fraudulent. Anyone can sit at their computer and punch in any number they like on a Form 1040 U.S. Individual Income Tax Return.

Thank you! I plan to provide my W-2/Earnings transcript and 1040 in lieu of the TT if it's still not available. When I contacted the Embassy a few months ago, they stated that they will start accepting K-1s as soon as they work through a backlog (my estimate was that they would complete that around December - seems like it was a pretty accurate estimate). All of this was just as of last week and they're pretty slow to update their website. When we logged into CEAC, we found appointment times available in December so we went ahead and booked one a few weeks from now. I got the notice just this past Tuesday that it was sent from the NVC and by Friday (yesterday), it was 'Ready.' I'm wondering if they're not piloting the electronic filing/documentation system.

Your plan for your financial information is a very sound decision. One that I would take if I were in "your shoes". In this process there are two "ready" conditions; one is when the electronic version arrives at the embassy and then the second "ready" condition indicates that the paper file has arrived. Good luck and stay engaged.

Q1 - You can begin gathering your TT if you think you will be interviewed by April 2021. If not it's best to wait as they want financial information to be current not 6 months old. It's hard to answer your questions if you don't help us by completing your timeline.

Q2 - Yes, you can file and then once you know your interview date then request the TT, but either way the TT only has one expiration date and that is when you add a year to the filing date of April 15th. (subject to change with the calendar year and where the 15th falls).

 

Q3 - No as paystubs demonstrates your current income. You could have lost your job and acquired another at a much lower income and your TT would not reflect that till the next tax filing but the paystubs is evidence for the period you submit them from.

How do I know which condition we might be in? I see this:

 

"Your case is ready for your interview when scheduled at the U.S. Consular section. You cannot determine what phase of ready you're in unless you follow your CEAC conditions closely, to include following the date changes of which there will be two in the "ready" condition. I talk about this in my PDF file that can be found on the first page of any NOA2 monthly thread. [Month] NOA2 to NVC to Embassy. In there you will also find a DHL hack which will enable you to see when your case was shipped and when the paper copy was received. CEAC and DHL are the only tools that we have found to come close to "guessing" the condition that the file is in.

 

The link you refer to in your replied post above, is for the immigrant process which tells you to complete the DS-260 Immigrant Visa Electronic Application [K-1's complete the DS-160, Online Nonimmigrant Visa Application] and how to pay your fee to NVC which K-1's pay their fee to the embassy using the embassy's instructions. Further, you schedule your appointment date and not NVC which was promulgated from your link. 

 

Until you receive the NVC letter that has your case number, and you receive your letter from the embassy which will have the P3 instructions you can only complete the DS-160, Online Nonimmigrant Visa Application and schedule your interview. You won't be able to complete the medical without the letter from the embassy. Be careful with scheduling the interview if you have no idea if and when you can complete the medical. On the day of your interview if you do not have the medical completed then your case will sit till that information is made available to the CO in charge of your case.

I have the NVC case number since April, and we completed the DS-160 back in July. We also scheduled her medical, but the instructions from the medical didn't say anything about bringing the letter from the embassy. Only that she should bring identification, her police certificate, photos, and vaccination records. From my understanding, she should receive the medical packet at the end of her exam but the only P3 instructions we could find (from 2016) say to schedule the medical early because "it takes a long time to get the results." She is going to call the medical provider on Monday to understand if there really is a delay or if she will receive them the day of the exam. Right now, her exam is scheduled a few days before the interview.

 

The biggest problem is that she lives 250 km from Chișinau and doesn't have a car. With the embassy already wanting some documents the week before the interview, three trips back and forth from Chișinau really isn't feasible in such a short period of time. It's better if she can just stay there for a week or so and do it all.

 

I did write to the embassy to ask if all of this will be ok, so I'm just pending an answer from them.

 

Will the embassy letter arrive via email? The postal system is still shut down in the villages in Moldova.
