E-mail this morning saying RFE was mailed 11-13-07..............

Yay, at least something is being done!!

Got the RFE in the mail today, they just need a copy of the divorce decree from my 2nd marriage. Will have it Monday, overnight it to CSC so they will have it Tuesday just in time for it to be buried on the case officers desk for the Turkey Day Holiday.

Almost there...............................phew.

Glad to hear it's an easy fix.

Well, strictly speaking, it isn't that crazy. I am a family law attorney, and I can tell you that here are some people who get married a second time without getting divorced from their previous spouse. They simply lie on their marriage license application about whether they were ever previously married. Apart from the fact that this is bigamy, which is a criminal offense, the legal effect of this situation is that the second marriage is null and void, and the person remains married to the first spouse. Nevertheless, the person can still get a "divorce" from the second "spouse" because the courts aren't in the habit of doing background checks on divorcing parties. If the issue never comes up, the judge just signs the decree.

Thus, if you simply provide the USCIS with a copy of your divorce decree from your second marriage, you could conceivably still be married to the first spouse, and therefore lack the legal capacity to marry your fiancee. Of course, legal capacity to marry, for both parties, is a requirement for the K-1 visa. I have a lot of problems with the immigration/K-1 process, but this particular requirement does make sense.

I have read your previous posts regarding your fiancee's (and her family's) impatience with the immigration process, and your fear that your relationship may not survive the delays.

Pardon me for saying this, but if your fiancee is willing to trash your relationship because of the frustrating immigration process, then what does that say about your relationship? If she does make it to the US, and you get married, is she going to be similarly impatient anytime things are not "smooth sailing"?

In my book, marriage is about unquestioning and unwavering loyalty and commitment. If I had a fiancee who implied that she was having doubts about marrying me simply because of circumstances beyond my control, I would dump the b*tch without a second thought. I am thankful that, in my case, I have a fiancee who is a lot more patient than I am with the process. Even though she is clearly disappointed with delays, she is always clear that her love is unconditional, and that she will wait and endure any hardships necessary to be my wife.

Obviously, I know nothing about your relationship with your fiancee. But if you seriously think that she might turn her back on you because things are not all peachy keen, then perhaps she doesn't deserve you, and maybe you should find someone who will love you unconditionally.

I wouldn't be so hard on T-Bone's fiancee. She could be just showing her frustration in particular ways. I would add that up to a cultural difference combined with her not understanding the process. I doubt she would actually care much about the delay if the relationship is truly failing.

On the otherhand, its never a good sign that she won't communicate. In a way, this long process has a way of weeding out relationships that are not on solid footing.

Visa took too long, grew apart and withdrew visa after six months.

Thanks to everyone for the interest, and apologies for my having injected negativity into this forum. It's truly the depth of selfishness when someone (me) sucks the life out of a discussion/forum/group, to whatever degree, rather than adding supportiveness and cheer.

One's MANNER of communication and how parties PROCESS communication are also key factors of perception, on all sides. I have made zillions of past mistakes in both manner and processing, and perhaps I can limit the future number to mere gabillions.

The fiancee and I spoke at length tonight, and I need not continue to out-stress as I have over the CSC's inaction.

Q: What did the self-centered French cow say?

A: "Moi!"

As atonement, let me be (one of) the first to sympathize with u2rsobad's CSC/NVC snafu. That's a nightmare that none of us wants to face but may have to, and we can certainly all hope and pray for an out-straightening and speedy rectification. ("Rectification" is cleaner than it sounds.)

I called CSC to get some information about If they received my mail regarding the RFE. Well, they couldn't help me with that saying that their system isn't updated and they don't know If they got it or not.

I know they have it cause I tracked the delivery and somebody signed for it.

Also, CSC is open on Friday and they are hopefully in the working mode that day.....:unsure:
