Absent from USA during visa process

I just found out my fiance is pregnant and I decided to leave everything and stay in Armenia and spend the pregnancy with her so she doesn't feel alone. We received word that our paperwork needs more evidence, I decided to stay and wait till her visa is approved so we can both (and our baby) go to the USA together. Is that allowed? Can I stay with her in Armenia till the Visa is approved? 

Our application is currently in this status and we are working on the paperwork (Request for Additional Evidence Was Sent)

Of course, you can stay with your fiance in her country.  Very little is needed for a K-1 to be approved at USCIS.  What kind of evidence is USCIS asking for?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You realize that you will have to show proof that you have sufficient income or sponsorship to support the new immigrant......and if the child is born before travel, then you will have to have proper documentation for him/her to enter the US.

The baby will need confirmation of US citizenship which will ease the visa burden of one. But you will need to file a CRABA with embassy. Use the embassy website for their procedures.

Assuming you have the legal permission to stay in Armenia (visa, residency permit, dual citizenship, for examples) then of course you can stay there. That’s between you and Armenia and nothing to do with USCIS. 
 

How far into the process are you? It might be beneficial to marry there and then and file a CR-1 due to the myriad of benefits it affords the immigrant upon arrival. If you are struggling with evidence for the K-1. getting married and filing a CR-1 would not be a bad idea. But it’s your call, of course.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
