Ok, I got an RFE asking for more evidence, I guess most of you read it. But since we live so close together and i have family where he lives, we dont have that sort of evidence... so what im thinking is: for him to just get his Non Immigrant Visa, that way we can get married and he can adjust status right away. A close friend of mine just became a USC in Dec 2005 and applied for his wife right away. By mid March she already had the permit to come and go out of the country as she pleases.

I dont know if this will have an effect on his interview... since we applied for the Fiance Visa

Well, think about it. He enters the States on a tourist visa, marries you and applies for AOS. USCIS will have to decide whether he changed his mind while in America, or commited visa fraud and knew he was going to marry you. Considering that you filed a petition for him... what's the most likely answer ?

I would not advise the "tourist visa route" to anyone, but in your case it seems particularly risky.

Yep. If you´re already in the K1 road, why change?

You can send in a statement that you live very close to each other, and think of ways to prove your relationship. There´s got to be something that shows it.

You can do this.....They are asking for 3 things from memory

CIRCUMSTANCE OF MEETING:

1. Submit further info regarding the circumstances under which the petitioner and beneficiary met to establish the relationship

A statement outlining how you met and your relationship. This is where you can also put in how you live close to each other etc....EASY

2. Submit original statements from you and or your fiance to establish mutual intent to marry within 90 days of their admision.

A Letter of Intent from both of you.......EASY

3. MEETING IN PERSON: Though you have submitted photos, they alone do not establish that you have met your fiance in person within the two-year period. therefore, submit evidence of meeting between you and the beneficiary in person

Look at the wording Karol.......... they alone do not establish .....All you need to do is supply something else. In your other thread you mentioned car permit..what is that??? You also mentioned a declaration from a Pastor. Charmac also suggested records of border crossings....is that possible??

You gotta try, please :( What you are talking of doing is rife with danger....For your fiance to apply for a non-immigrant visa, come there, you get married, then AOS is asking for trouble when you had an petition in for him and withdraw the petition after they sent you an RFE for more evidence.

Listen to Aussiewench, please Karol....Before I knew it was illegal, I thought my fiance and I could go down the same route (and I have yet to file), but the risks are too great.....they could deport him and give him a 10 year ban. Nothing is worth that.

Do you have any gas receipts? CC statements of while you were down there?

Karol...do not do anything that might work against you guys...knowing how hard is for people from Mexico to get their legal status you really have to rethink your situatuion...you are getting some great advice from people here and I agree with them...another thing that you should maybe consider is getting married in Mexico and change K1 to K# but do not go the turist visa way because it can just complicate the situation...you can get it done...it is not hopeless yet...thnk about it

I think Aussie gave you great advice there, as well as the other members. All we know for sure is that going the turist way is illegal, and if it´s illegal, there´s got to be something wrong with it. Besides, you´ll be closely watched now that you already filed for a K1. He might not even get a turist visa anymore.

You can handwrite (or write on word processor) the quick-and-to-the point

To whomsoever it may concern:

I, <your name>, do declare that I am intend to marry <your SO's name>, making the choice of my own free will.

<your name>

Note: if handwritten, your name at the bottom will suffice as signature; if word processor, then you will need to sign it.

(exactly as the Letter Of Intent from Pras that I sent with the petition)

I have a quick suggestion...( apologies if it's already been mentioned...) but what about signed statements from families/friends or anyone that was with you two while you were together in the 2 years before filing?

I am sure it would not take too much doing, getting family to sign a letter detailing some dates and then notorizing the letter....

Did that make any sense?I am still new to all this myself-but maybe that will help, especially if you send a letter with the RFE request stating the problems associated with living quite close together and having no passport stamps or plane tickets...etc....
