Hello everyone,

My fiancé was on an esta before we got engaged but overstayed last year by 13 days so his esta was cancelled. We got engaged and we filed the K1 Visa on June 8, 2020. We received the receipt number but haven't heard anything and haven't seen each other in a year and a month. Is there any other way he can come here while waiting on K1? I am to go there next month but a bit scared with the covid numbers. Thank you.

If he can get a B2 he can certainly try to visit.  I think the hurdle will be getting the B2 with an overstay and canceled ESTA.

Good Luck!

He can attempt a B-2 but with a previous overstay and a K-1 in the pipeline his chances are very slim. That’s if London and Belfast are even offering B-2 appointments at the moment (which I don’t believe they are).

On top of that is the travel ban from Europe. Fiancés are not exempt, only spouses. So even if he got a B-2 he would then have to “quarantine” in another country that’s not on the travel ban list (Mexico us currently a good option) for 14 days before entering the US. Upon arrival back in the UK he will also need to quarantine (currently 14 days but being reduced to 5 from mid-December if you pay for a very expensive COVID test on arrival).

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Now a US citizen!

He can try to get a B2 visa, but it will likely be a waste of $160.  Seems odd to have originally posted this in "AOS from work/study/tourist visas”......

^^^ this. Almost no chance he will get to visit. Such a shame he threw away his VWP privileges.
Presumably OP is aware of the requirements for UK quarantine if plans to visit next month?
