Either way... I wonder if it's any "point" in joining the lawsuit now. I emailed the lawyer and was put on a list to receive more information about it, so me and my fiancé will at least discuss it when we know more. But I'm thinking too that it was mentioned in the news not too long ago that several agencies within the Trump administration were talking about lifting the travel ban for Europe (and maybe Brazil too if I'm not mistaken)... it just feels like such a gamble either way and I don't know what the best thing to do is... 😶

I’ve learned that it will cost $2000 to join in the next round of plaintiffs. I don’t have that kind of money to put into this so I unfortunately will be in the wait and see category here. I am trying to remain hopeful that something will come out of this for non plaintiffs or the travel ban will indeed be lifted by Trump or Biden after his inauguration. Once processing does begin for non plantiffs, I think my petition will be close to the top as we were approved at the end of March, so that is something to keep me positive.

We're talking and praying about it and will see what we decide in the end. But one thing that I thought about, that at least applies to us, is that every month that we have two households is a month where I'm spending about $1000 on bills and food and other things like that. I'm currently not working so it's all savings right now, but I will most likely start studying some online university courses next semester (that I could do from both here or the US, I assume). So that's something for us that still speaks for joining.

 

But it's still a lot of money, and also with the not knowing what's going to happen and when it's going to happen. It's like... will the travel ban be lifted next week or next month or during the summer or when? And when it's lifted, how fast will they start processing K1's again in Stockholm? A lot of countries aren't processing even though there's no travel ban, which another girl that considers joining from Denmark mentioned to me. So it's all just such a mess and it feels kind of like a gamble. 😶👀

You bring up some good points! I think the uncertainty has been the worst part in all of this. And it must be super hard on you and your fiancé to be sooooo close. I wish you luck in whatever path you choose!

am debating whether or not to join the milligan vs pompeo lawsuit deadline due next week. I am curious if my fiance is in Colombia and the bogota embassy is not processing visas currently if this would be worth it. It’s obviously 2000$ to join so i just want to make sure it would be worthwhile and the bogota embassy would indeed grant interviews. Thank you in advance. I see people getting interviews but havnt seen any in colombia yet

Yeah I am in the same boat. My case has been at the NVC since April and there has been no meaningful movement in India. Not sure if joining this case will help me as it is not a banned country. That means the TRO wouldn't apply to me and by the time hearings and such happen, we probably have a new administration as is. The question really seems to come down to priority. Would being a plaintiff on this lawsuit get my case handled with priority over others? Based on the rulings and state department guidance so far, no. But if that was really the case, then there wouldn't be a need to add more plaintiffs as they would be handling ALL K1 cases (especially from the countries impacted by the ban and the TRO).

Judge has made a favorable decision in regards to plaintiffs, whos fiancés reside in banned countries.

Looks like for those fiancés, who live  in the countries that ARE NOT BANNED(not PP), the decision is in favor of Department of State.

 

Is this right?

 

If so, what are the chances to have a favorable decision for fiancés living  NOT in BANNED countries in this lawsuit since it is not over yet?

Yeah, and this is what the lawyers say in an FAQ for people considering to join the lawsuit:


If the court allows additional plaintiffs to be added to the complaint, new plaintiffs from the proclamation countries can expect to benefit immediately from the injunction. In other words, the government will not be allowed to rely on the proclamations to stop processing or adjudication of their visa applications.

 

New plaintiffs from non-proclamation countries, on the other hand, are much less likely to benefit from the injunction that is currently in place. They may benefit in the event makes future orders regarding unreasonable delay and they may want to consider filing individual actions. Any of the law firms co-counseling on this case can handle individual cases and you might consider setting up a consultation with one of them to discuss this option.

 

 

And for those who live in a banned country there's the possibility of being allowed to travel directly to the US IF a national interest exemption would be granted. I wouldn't count on it, though, but you never know...

 

Also, for those in countries subject to 14 day entry bans, we are arguing that the law that is the basis for that proclamation is not meant to cover the issuance of visas and we also are arguing that the government should create a national interest exemption similar to what they have done for other immediate relative cases.

I get not having the money, but there's zero risk involved at this point. The second round plaintiffs also paid 2k, it wouldn't make sense to make it cheaper for a third round when there's an actual guaranteed result already.

Still doesn't take away the fact that it is $2000 extra into the immigration process. I was just saying it's too bad that this is happening in general. I wish we didn't have to pay an extra $1000 or $2000 or for a stay in another country for 14 days or another flight. You get what I'm alluding to, right? I was just stating that it's unfortunate that this is happening to everyone. My comment did not take away the value of your investment in the lawsuit.
