How to answer Part 12 Question 7

Hi,

My mother is dependent on my sister for food and shelter as my mother does not have any source of income. They are claiming her as dependent on their taxes. 

How do we answer questions 

7A. Have you ever not filed Federal, State or local taxes, since you became permanent resident  : Yes or No

7B. If you answered Yes, did you consider yourself to be non-US resident  : Yes or No

 

We are thinking of answering as follows :

7A : Yes  (She did not file because she does not have reportable income)

7B : No    (She never claimed as non-US resident on US taxes)

 

Will there be any place in the online application to explain ?

If I understand you right, your sister claimed your mother as a dependent in her tax return, which means your mother's name and social security number was in your sister's tax return. If so, then  answer  7A: No

and 7 B:No. I answered this way for my daughter who is an adult living with me but studying and not earning income. No issue was raised.

Your mother may get tax transcripts with her when she goes to the interview to show ONLY IF REQUESTED.
