My fiancée got a one year ban in Feb. 2020 for admitting to previous cannabis use though she tested negative.  She went for her Re evaluation this week and again tested negative.  The doctor told her however, that between now and end of January he may call various times to have her go get drug tested again and as long as all goes well she would be approved.

my question is that since she is employed contractually in another city that is a one hour flight and would need to request time off she is not necessarily entitled to per her contract, can she see about having it done somewhere in the city she resides and works in or no?

With 2 negative tests completed, it seems like a long shot that he would request another test in my opinion, especially within such a short time. Most doctors are pretty busy right now. I would wait for the call, and if it comes then explain due to work a trip back would be difficult and ask if the test can be done locally. As others have said it would be up to the doctor, but I can't believe the doctor would seriously be sweating someone over some cannibis use.

Yes, clearly this is something to ask the doctor.  The reason for the post is because during the exam she mentioned to him the situation with work.  His response was that it was out of his hands which seemed Kind of odd in that respect.   Thanks for your responses.

I just cancelled my fiance's K1 interview because I learned that cannabis is a deal breaker. He has stopped smoking now so we will reschedule it for a few months from now when he can test clean.

 

I've been searching for stories just like yours about what will happen to us if he is honest about past cannabis use. Thats HORRIBLE that this happened to you, and exactly what I would hope doesn't happen to us. 

 

Everyone says "don't lie, never lie!!!" but damn, if they're going to punish you so harshly for being honest even if you've verifiably cleaned up your act... do you wish she had tried to tell them "no, I have never smoked before" when they asked her? 

 

My other fear is that they hold the power to just DECIDE that you are lying, even with a clean test, based on your physical appearance, and then punish you more severely (like perhaps a lifetime ban?) for lying to them. What are your thoughts/do you have any info on this? 

 

Thank you. I REALLY hope your fiance gets to join you soon. It's so cruel that they treat people like this over cannabis.

But he would be lying, sounds like you have got a long way into the process and only now he is cleaning up his act, he has had a very long time to do that.

The question of drug use generally comes up at the medical not really the visa interview. Being able to test clean doesnt necessarily mean that someone wouldnt be put on a 12 month hold for drug screening, its all about the past use and one must be honest about that with both the CO and the Physician

I strongly recommend that your fiance just be honest instead of worrying about whether he'll be caught based on his appearance.  We tell people to never lie to immigration officers nor on any immigration document because we have seen many examples from other members' posts about the long-lasting consequences of lying.  Yes, depending on the lie, more severe punishment like a permanent ban is possible.

 

Also, note that there is no statute of limitations on misrepresentation on immigration-related matters.  A lie now can mess up your fiance's green card or citizenship prospects in the future.

Update: Drug testing over the last year is complete and all passed.  Medical re-exam done.  Dr said to wait and hear from the embassy.  Just wondering if my fiancée will need to interview again with the embassy or just submit her passport?  
Last year she went for her interview before they received the medical results and they told her all was good, pending the results which unfortunately lead to the 1 yr ban.  I appreciate any information.  Thanks!

Thank you for posting an update on your fiancee's case.

 

It's up to the consul officer if they want to do another interview.  Likely not.  Sometimes they ask the applicant to present themselves at the embassy just to renew their oath that the statements in their application submissions are true.
