Yes, it can be! Yeah, I had to write a letter explaining why I withdrew my last petition, and I included a copy of the withdrawal acknowledgement letter with my new petition as well as why my last 2 marriages ended in divorce. So, this is my 4th petition, which is why I had to include more documents and request for a multiple filer waiver with extraordinary circumstances and include an explanation of my past criminal history with my records showing the original charges were dismissed.  I think the fact that I included all of my documents and then some my petition should be ok, that's what I'm praying and hoping for. But we shall see. Hopefully, it won't take long this time. I think the other reason my last petition took so long, and it never made it to initial review was because when I filed my petition that time my criminal case was still open and I got an RFE for the criminal record because I didn't include it with the original paperwork, due to the fact it was still open. I probably should have waited that time to file my petition, but I was given poor advice by USCIS tier 1 officers and tier 2.

It's my opinion that it shouldn't take long but long can be 6 to 8 months. See some longer but since you have been to the rodeo, it may be just the dotting of the "i's" at this point. I must agree that without the court record it couldn't get adjudicated. Now that you submitted it with this I-129f, Petition for Alien Fiancé(e) it's just a matter of time.

This is why your case(s) went to Vermont.  The very small portion of 129F petitions that are transferred from CSC to Vermont have criminal backgrounds that need additional adjudicating.  This is why there is hardly any data reported here on VJ.
