Ending K-1 and going for AOS

Timeline

So we have decided to end our K-1 process and get married and go for the AOS. My question to anybody out there who might know. What if she gets the Green Card yet the passport from her country has expired? Does she go to her countries embassy here in the USA to get a new passport? I am assuming she cannot travel outside the USA on an expired foreign passport? Any advice appreciated.

I believe the US is recognizing Venezuelan passports up to 5 years after their expiration due to the difficulty in obtaining a new one. AFAIK they arent issuing new ones currently.

 

Was your fiance here while the K1 petition was processing? Or how are you AOS?

Yes, I found that out from the Venezuelan Embassy site on the 5yr recognition. Yes she is here while the K-1 is processing, but we are running out of time to hit the 6 months overstay so we will opt for the AOS and stop the K-1.

If you get married and file for adjustment of status, she cannot leave the US without AP or you abandon the AOS process.  She cannot work until receiving the EAD as well, both are taking 6-8 months, and green card, much longer.  Good luck with the AOS process!
