New Receipt / Case Number after Filing Divorce Waiver

Are you talking about for the I-751, Removing Conditions on your green card?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

yes. I had initially filed jointly with my EX-wife , then got divorced and sent USCIS my divorce decree and a new i-751 form to amend/switch to divorce waiver filing.  so i received a notice with a new case/receipt number different from the initial one sent to me when i filed jointly. is this normal?

I had never heard of this situation in my many years on this forum, but perhaps somebody has.

Be patient during this weekend and holiday week until someone definitively responds.

You should not have sent a new 751. Its not a major problem that you did though. The 751 form is unique in that you can file it multiple times. Thats what you did. When you have a pending joint 751 and want/need to switch to a waiver type all you need to do is send a letter requesting the original joint 751 be amended to a waiver filing. You didnt do that. Instead you sent a new 751 with the waiver boxes checked. They accepted it as a new 751 filing. I am assuming you paid the fees again right? If you sent a letter amending your original one you wouldnt have had to pay the fees.  Just keep track of both the case numbers. The original 751 should reach an Officer for adjudication before the second one since it was filed earlier. The Officer should be able to see your second 751 filing and process your case accordingly. I say 'should' because thats what is suppose to happen. Things dont always happen like they should though. So you can withdraw your joint filing but personally I wouldnt because IMO you are more likely to cause more issues for your case overall by withdrawing it. Its not a big deal to have 2 751s pending. Since they have an internal process for dealing with multiple filings for 751s  I would just let them do their thing and correct it how they do w/o withdrawing. You can sending a letter asking to amend your joint filing though, as well as advising them you did send a second waiver filing and provide the NOA case number for it. This will ensure that when they get to your joint filed 751 they are aware you filed a second one and are switching to a waiver to ensure the joint one isnt approved incorrectly because they overlooked the fact that you filed a second waiver one. I dont foresee them making such an error but as options to try to fix this multiple filing situation - either leave it all alone and just track both cases or send a letter as described above.

Thanks for your response. I didn’t pay another fee. My lawyer interfiled it. So when I received a new notice/receipt number , it says that fees was previous received in the notice . 

Also I was at the field office during the week to obtain a stamp on my passport , the officer took a photograph of me and fingerprinted me and stamped my passport.  Is that normal ?
