Hi all, I'm a USC and my LPR husband is preparing Form I-751 to remove the conditions on his 2-year green card. We're wondering how much information we should include about the fact that we were abroad for several months during the past year.

 

I was working on a temporary basis in the country where he is from, and we stayed there from mid-June until November 2019, when we came back to stay in the US for about a month before going abroad again. I came back to the US in March of this year but because of covid he was stuck there for another few months, until he was finally able to get a flight back to the states in June 2020. We never intended on him being out of the US so long, and were only abroad on a temporary basis. We maintained US bank accounts, had American employers, paid US taxes, etc. the whole time.

 

I'm worried if we include our foreign address as a "residence" on the I-751 that it will look bad, though we are both in the US now and don't intend to leave anytime soon. I'm concerned omitting that information could also be bad. Any advice? Thanks so much in advance!

I suggest do not omit anything, provide all addresses where you were for past two/five years as the form requires. It is not a crime to be abroad for work. I for one not in the US for work, and will be away till 2022. I filled my ROC few days before I left. I had to make sure everything was filled correct and the information was OK. I called them for change of address since the system doesn’t have foreign address option they advised to give them a trusted US address. And I have been receiving mails from them through that ever since.

 

like my entry permit, my extension letter and biometric. Since you have evidence I will suggest to put everything and copies of say contract, tickets, if you guys had health insurance while working abroad put that as well. Pictures and everything that can justify your case.

advise is be honest about the answers. do not try to cover up anything. You know they can lookup into the arrival departure info and check out if you are lying :)

Just add a paragraph to your cover letter about your work situation and how your spouse got stuck behind because of COVID.  That way, the answer is in front of the adjudicator instead of raising questions.

As long as petitioner was not out of the USA for more than 180 days at a time you should all be good, do not omit any relevant information.

 

Along with the statement with the narrative explaining what happen during your marriage also provide documentation of communications between the two, email, messages, records of calls when you were apart, document financial support provided one another when apart as well.
