Chaps, I have my adjustment of status, request to travel and auth for work all sent in and waiting for next stages: on a K1 Visa.

HOWEVER, I have an urgent requirement to go back to the UK due to my parents health failing rapidly (Not COVID).

I tried to call the help line, but the computer system for calls gives me the run around and then kicks me off.

I dont want to go back without advice, but I have no choice, after 18 months of work into this.....

Who can I talk to? What number should I call?

I have emailed but I never hear back for 6 weekds normally when I do that......

Thanks

SB

I think others in similar situations were able to setup an infopass appointment to get an emergency AP.
I am sure others will chime in though. Get together any proof you can about the failing health as they will want it. (dr notes and stuff like that)

There are some helpful posts on the USCIS subreddit about this. Try searching there.

Thanks - I'll look.

The appointment is only scheduled through the help line by talking to a human at USCIS.

Spoke to the chaps, which was good, sort of. I cant get an AP becuase I have not had my biometrics done.

So. I'll call US Embassy in UK tomorrow, but it looks like I'll have to invalidate my K1 at the last hurdle.

I'm not happy.

If you know you'll abandon AOS, the US citizen can file I-130 online to start IR-1/CR-1 process: https://www.uscis.gov/i-130 You can visit the US with ESTA while you wait: https://uk.usembassy.gov/information-for-nonimmigrant-visa-applicants-following-the-coronavirus-covid-19-outbreak/

  • Do not attempt to check in for your flight online if you have an ESTA registration.
  • Arrive early for your flight.
  • Carry any documentation that you believe demonstrates why you have been excepted from a travel restriction, such as a Permanent Resident card (commonly known as a Green Card), a marriage certificate, or a birth certificate, so that it is available if it is requested for review.
  • You may also wish to carry a copy of the Presidential Proclamation itself.
  • Your status will be reviewed in consultation with U.S. Customs and Border Protection (CBP) officials.

I will make it simple for you;

- If you go back without having AP on your hands, your application is deemed abandoned and you will have to start with a CR1.

- If you want to continue with the K1, forget about traveling unless you can have the AP.

Evaluate and make an informed choice.
