Do you think the affidavits are necessary? The USCIS explicitly ask for TWO affidavits:

  • Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Affidavits must be supported by other types of evidence listed above.

IMHO affidavits are useful/necessary if not enough documentation is available.

It seems that starletth has a comprehensive list, but of course each case is unique.

But my reading of it is that they are required, not just useful.

Can anyone confirm or deny it?

That's good! Anyone else?

I'd really hate to involve other people in our immigration business. So far I have:

  • 3 years of joint tax returns
  • 3 years of bank statements showing our direct deposits and checks
  • joint apartment lease (the original contract and one renewal)
  • health insurance policy (my wife's enrolled as a dependent on my policy)
  • car insurance (in both our names)
  • joint utility bills (gas and electric) from ConEdison - 2 years
  • photocopies of our driving licenses showing our address
  • insurance policy with my wife as the beneficiary
  • 401(k) papers with my wife as the beneficiary
  • probably a couple of other things I forgot

Do you think it's good enough?

we sent off our package without any and I were approved with no problems ...

If i remember correctly in the instructions it doesn't really say they are necessary but just a suggestion and they probably would be a good idea for someone who might not have a lot of other evidence...

The documents should cover, but not limited to,the following examples:

*Birth certificate(s) of child(ren) born to the marriage.

*Lease or mortgage contracts showing joint occupancy and/or ownership of your communal residence.

*Financial records showing joint ownership of assets and joint responsibility for liabilities, such as joint savings and checking accounts, joint federal and state tax returns, insurance policies that show the other spouse as the beneficiary, joint utility bills, joint installments or other loans.

*Other documents you consider relevant to establish that your marriage was not entered into in order to evade the U.S. immigration l

*Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship.

and remember to include a photocopy of the front and back of your green card.. I almost forgot to do that...

I wouldn't include 3 years worth of bank statements or 2 years worth of utilies.. that seems like a bit overkill... all I did was submit the latest bank statement and the latest utility bill but if you want to be on the safe side just submit one statement/bill from the beginning of the 2 or 3 years and the latest one...

I also only submitted the latest tax return...

otherwise your list looks good.... that is about all we submitted ... and like I mentioned in my above post.. we were approved with no problems...

just to give you an idea this is what we included in our package ....

copy of baby's hospital certificate

copy of baby's death certificate

copy of rental agreement

copy of car insurance

copy of one recent joint tax form

copy of 401K that states that I am the primary beneficiary

copy of health care statement showing that I am covered under hubby's health care insurance

copy of one recent gas bill

copy of one recent phone bill

copy of one recent cable bill

copy of recent bank statements

copy of paper showing that hubby added me to his bank account

Copy of some bills (Sirius, Netflix etc) with just hubby's name and our address on it

Copy of some bills with just my name on it and our address (recent electric bill etc..)

Some envelopes with both our names and address on them...

I just sent in the most recent bill for each utility.... The phone and gas were in my name but I added hubby's name, the electric company didn't let me add my hubby's name...... and I just included the most recent bank statement.... and the application that we filled out to add me to hubby's account...
