Dear all,

I have question regarding my AOS application which I sent out last week. I am currently on J1 visa and I am married to my US citizen husband. Since I am on J1 visa, we summited in the I-485 package the most recent DS-2019, the most recent I-94 reflecting entry on J1, most recent j1 visa stamp reflecting that I was subjected to the two years HRR, and USCIS waiver approval for this two years home residency requirement. I realized later that USCIS is asking to submit all ever issued DS-2019, I-94, and J1 visa stamps if they are available. I am worried now if USCIS can denied my application because of this mistake.

I'm sure that they would just send a request for evidence. If not, you could always appeal their decision, and it would be most likely resolved from that.

Thank you very much for your response. I hope that they will let me submit the paperwork if needed. It made me feel better to hear your opinion 🙂

Of course! I have had previous J-1 visas from years ago, and had a really difficult time trying to gather DS-2019s. I sought some legal advice, and the lawyer told me that they would most likely request more evidence.

Thank you. That is a useful information. I actually used a lawyer for the AOS filling. They seems experienced and did a very good job with the rest of the application. I just realized later on that these additional J1 visa documentation was missing in the application. They also told me that if USCIS need more info, they will ask for it. I was just afraid since I read that USCIS can denied the application when some initial evidence are missing. But I think (hope) it make sense that they will not denied the application just for this.

Hi dansea,

 

I just wanted to ask you if you received some RFE or RFIE for the DS-2019s which you were no able to attached to the AOS package? USCIS received my AOS package on November 16 and I did not received any RFE so far.

Hey Veronikac, 

 

I haven't received a RFE. I don't really expect one for the DS-2019s, as I no longer have possession of them, and I submitted evidence from my J-1 sponsor to show that they also didn't have a copy of them. I did manage to get a letter from the company stating that I was not subject to the two year overseas residency, and that they are contactable if USCIS should require further information. 

I'm sure you're going to be fine though!
