Concurrent Filing cover letter check

Hello everyone!

 

I believe we have everything in order to file concurrently. I-130, I-131, I-485, and I765.

 

I am worried about my cover page and was wondering if anyone could give me any advice and double check for me.

Do not forget  I-944

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Difference is that I-944 mainly focuses on beneficiary (but also asks about beneficiary's household members). Your I-485* filing would be rejected if I-944 isn't included.

 

*also I-765 and I-131 would be rejected as they are dependent on a properly filed I-485.

What if they are already in the USA my spouse is already here. I am just asking since the form is about "Ground for admissibility"

Those adjusting status must also be "admissible" as some potential actions done inside the US can make the adjustment applicant not "admissible" as a LPR. See the Policy Manual: https://www.uscis.gov/sites/default/files/document/policy-manual-resources/Appendix-PublicChargeApplicabilitytoFamily-BasedAOS.pdf

 

Also, Form I-944 is specifically for adjustment applicants. Those applying for Immigrant Visas abroad don't use Form I-944; DOS was about to implement a similar form for them but a federal court has temporarily blocked the implementation. https://travel.state.gov/content/travel/en/News/visas-news/update-on-public-charge.html

 I would put the I-693 too. Better do it at the start so that your medical history is known. Then just update it at your interview, if the interview comes after a year.

I-693 retains evidentiary value through

More than 60 days before applicant filed benefit application with USCIS
