hi all,

anybody gone through this situation that can help?...

when we filed our k1 paperwork i was still living at my mom's house, so i used her address on all the forms. during the k1 process, i moved out, but still used my moms address so as not to slow down the process before the k1 was issued. we are plannign to get married in the next couple weeks and are now thinking about the paperwork for aos.

do you think it is ok to put our new address on all the forms for aos or should we continue to use my moms address for less confusion?

what are the pro's and cons for each?

also, i'm not sure when to apply for the ss#. eugine doesn't have his ead yet, and we'll be applying for it with aos. when is the right time to apply for the ss#: before we send of aos documents? at the same time? i've heard something about needing to get the ss# at least 2 wks before the 1-94 expires...hmmm?...

advice most welcome!

His SSN card will say "Not valid for work without DHS authorization". You don't need valid work authorization to get a SSN. It's form SS-5 and you can download it from the ssa.gov website HERE.

For your AOS, just use your new address as the mailing address.

If he gave your mother's address when coming through immigration he will need to file form AR-11 separately, and mail to the appropriate mailing address (different to the AOS filing address) to inform USCIS of his new address also.

and you, the US sponsor/spouse will need to send in an I-865 change of address notice as well.

Yeah yeah I know, the instructions say its only if you've already got an I-864 affidavit of support in, but they also want it if you've done the one for the K visa as well (I forget that #...I-13???). My husband and I had to do both of those, even tho he moved *before* I got my visa, and we put his new address on the K3 visa applications and DS forms at the interview. When I crossed the border they told me I would need to do that because of the different addresses on all the forms. :blink:

SSA will not assign an SSN or issue a card if his status has expired or is within 14 days of expiring.

K-1 status is good for 90 days, so that only gives him 76 days to be assigned an SSN and issued a card. After that time he will need an EAD or I-551 card to establish authorization to work. Before that time the

I-94 showing K-1 status is the document that establishes authorization to work for SSN purposes.

The status/documents of all aliens must be verified before SSA will

assign an SSN and/or issue a card and the 14 day limit applies even if

he passes the 76th day while waiting for her status to be verified.

The SSA office will try to verify his status through the SAVE system

while he is in the office. If they can't, they will send a form G-845

to immigration for manual verification. This could delay the assigning

of an SSN and/or issuing a card for weeks and some times months.

If the SSA office does send the G-845, suggest that he go back to the

SSA office no more than once a week with your documents to (1) ask them

to check SAVE again (2) ask if they sent a G-845 (3) if yes, did it come

back (4) after 30 days ask if they have followed up on the G-845 by

calling or sending another mark "second request."

STEP 6

DHS should respond to SSA within 15 federal work days after receiving

the Form G-845. If DHS does not respond within 15 federal work days from

work days of mail time for the G-845 to be received at and returned from

Suggest that he take his birth certificate, passport and I-94 when going to apply. That should cover age, identity and work authorized alien status.

The original document, or a copy certified by the issuing agency or

custodian of the original record.

Uncertified photocopies and notarized copies are not acceptable.

A receipt from DHS showing the alien applied for the document is also

not acceptable. The applicant must present the actual document.
