Hello all,

 

We recently had an interview for my husband I-485 AOS and it went well as far as we know. There is an issue here, We been together from many years and married after dating close to 5-6 years. My dad was very happy and witnessed our wedding and signed our wedding in the court. After 3 years of happy marriage life, he started to trouble my husband and me and asked me to divorce my husband, if not he will report to the U-s-c-i-s that my husband married me for GC. During the interview, the officer questioned me about how my dad feels about the wedding and why he thinks my husband married me only for GC.(which is not true, my dad complained out of personal hate and trying to prove to u-s-c-is that it is not valid even though my husband and I are honest) 

 

The officer asked us general questions and later said I am unable to make a decision at this point and I will mail you a final decision. I am very worried about the outcome even though my love and relationship are strong and real. 
 

please advice and suggest what might be the case in this situation. Thank you all.

That was a normal response by the officer.  Your father has no power in this situation.  I see no reason to worry.  Just watch the status of the case.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I am worried since my dad paid a lawyer and sent his false complaint to the interviewing location. The officer questioned me and that’s when I found out that the compalint went through. I was very upset, depressed and sad to prove to the government my love is real when someone is saying it is not out of hate. I hope u-s-c-i-s doesn’t give too much weight to false compalints and I have almost a decade worth of love to prove.

Unless your father has direct evidence, I wouldn't worry about it.

As far as I know, he is saying things like they did not live together and never had sex. 
I was going to college in my home state and my husband was working in another state and we were meeting frequently and decided to finish my college, find a job for me and settle down. In the mean while, my dad started this whole issue.

Presumably your father is no longer part of your life.

Nope, we moved out and staying at a different place and reported the new address to the u-s- c-i-s

 

I am very worried on how much weight does the department puts on my father’s complaint even though they have many reasons to believe that we both are husband and wife(9+ years of love and still going strong)

Weird family members is not that uncommon.

How did the Officer know about your Dad's complaint? Did you tell them what your Dad said I.e brought it up yourself?

No. My dad sent the complaint with the help of a lawyer to the interviewing building. He opened the interview notice without my husband and my permission, took a photo of it and drafted the complaint with a lawyer and sent it so that it reaches before my interview date and time. He even asked me to divorce my husband and asked me to stay home and not attend. I left the home and we both attended the interview as normal. There the officer started off as usual (the officer is very cool and composed) asked general questions and towards the end raised two questions about my father. That’s when we found out that the complaint went through.

Your father must find therapy, he controls your life too much.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
