Hi all

 

Has anyone done any work remotely for an overseas company while in the USA awaiting your EAD or GC? I’ve been in the USA since Nov 2019 and I was not expecting to still be waiting a year later. I have the opportunity to take an overseas based contract, working remotely. Has anyone else done this? As far as I can tell because I have been here so long I am

considered to be a US resident and will have to pay tax. WHAT AN ABSOLUTE JOKE! But anyways. Thanks for your help.

You actually are not permitted to work at all, without a work permit or GC, even remotely for an overseas company.

 

When did you apply for your EAD and GC?  Have you put in an inquiry to USCIS?

How can it possibly make sense that I cannot work for a company in my home country where I am still a citizen? Do you know where it says I cannot work at all? It’s financially unfeasible to be in this position for so long! I finally got my biometric appointment so now it will probably be June by the time I have my EAD

These decisions should have been made before you chose your visa path. The US government considers work of any type, even if the employer is overseas, to be work. There is no differentiation. Work is work. And work is not permitted without an EAD or green card. That’s just how it is. 

 

The spouse visa would have alleviated this issue but that’s too late now. It’s useful to point it out for any readers here who are still wondering which path to take. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
