We filed for a k1 visa and are doing a waiver because of a weed charge but we were unaware that the amount was over 30 grams. A lawyer told us the best thing is to get it ammended by a criminal justice lawyer in Jamaica. The criminal justice lawyer told him she would expunge clear the history but the uscis already saw that he was charged for it but are requesting the amount. Does ammended and expunge mean the same thing? Any advice

Does not matter, either is meaningless for Immigration purposes.

It does matter,  the lawyer said it can be amended (lowered) to under 30 grams due to certain factors of our case ( which we could still get approved with one simple possession of 30 grams or under), uscis just needs the amount he had,So I’m asking if ammend  Means the same as expunged in Jamaica, just trying to make sure we get the right thing done

What he is trying to convey is that regardless of charges amended or expunged, for immigration purposes they want to see the original charges, and the entire court record from the charge.  You will need to hire a lawyer here in the US and in JA.  It is going to be a lengthy process. 

 

Marijuana regardless of state relaxation in the US is still a federal crime of moral turpitude.  With the amount that he had on him, it is considered a felony.  Less than 30 is considered a misdemeanor, but it does not resolve the issue of it being a federal crime of moral turpitude.

Well there is a criminal issue and the medical issue, now not an area I know much about but would this amount fall into dealing rather than personal consumption?

Check out @LionessDeon her VJ Journey was for possession but it was not as much as 30 grams.  As @Boiler stated in most states that much is considered intent to distribute.  However we all know in JA the laws changed and anything more than 2 grams on a person is a crime.  

 

LionessDeon used LIzz Cannon as her attorney for her waiver.  She is not cheap, but she is versed in JA Marijuana Issues.  She will do a free consultation.  Like I said, this issue will not be resolved for a couple of years.

What you are doing is trying to reduce the consequence, it is already there so you need a good lawyer.

I checked with friends and 30 grams could well be for personal use.
