K1 Issued K2 still not complete

My fiancé’s K1 was presented to him on Friday 11/13 but we still have no answer on the K2. The visa is only good for four months so we are concerned that with Covid and all the upcoming holidays that the K2 might not be resolved in time. We waited a year after the embassy interview then filed Writ of Mandamus which got the case moving. How long after K1 approval has it taken to get the K2 answer? It isn’t possible for the boy to follow as he is only 7 and must travel to the US with us. My fiancé has sole custody and has since the joy was 19 months old.

How long after K1 does it take for the associated K2 to be completed? Have you ever heard of a K1 being approved and a young child K2 being denied?

K2 is a derivative and would only be refused if non custodial parent permission was required but not given

YMMV

The Embassy asked that the sole custody agreement  be modified to add “May immigrate to and live indefinitely in the United States” which was done in August of 2019. My question is how long should it take to get the K2 completed? We haven’t much time since the clock on the now issued k1 is ticking. We effectively have only three months.

You asked two questions in your post.  I answered the second one.  As for K2 timing, it all depends on the consulate.   It normally is but a few days, however, with covid,  who knows....

YMMV

When we tried to schedule last year (pre covid) it took us a month to find an open slot.

We’ve been waiting since April for an interview.

They tend to blame covid a lot. We were able to get an opening by getting my congressman involved. I know Beirut is very slow and only do interviews a couple mornings a week at this point. And none in the next two weeks due the the current shutdown that started today.

Yeah! It makes no sense. I contacted my congressman as well but he didn’t even bother to help, he just said he couldn’t force the embassy to give us an appt. without even trying other ways. All we can do is wait at this point

If you didn't go anywhere with your congressman then try your senator. The mere fact that a constituent wrote highlights the problem with USCIS the better. Your inquiry may not have been in vain. Don't give up. Good luck and stay engaged.

USCIS?  They are waiting for a k1 interview at the consulate.   Not much can be done until resumption of visa services.

YMMV

Thanks for the catch. I assume without checking that they got their congress representative involved, because it is normally done at the application stage and not interview. Of course, you and I know that most embassies are slowly opening and if not open a congressional inquiry will not move it ahead at the embassy stage. It's funny how a post can be made and then a few hours or a day later the OP gets the news they had been waiting for. Trust the process.
