I-130 upgrade after naturalization

Hi all,

 

We would like to know what is the procedure to upgrade the form I-130 for Spouse after Naturalization and how much time does USCIS take to upgrade.

My wife submitted the I-130 application when she was a lawful permanent resident in March 2020 and she got the receipt stating that the process in review.
She  became a US Citizen on Sept  2020 and then she called NCSC to upgrade the petition on the same week , but when she raised an enquiry on USCIS last week they informed that us that our petition still under lawful permanent resident category.

We would like to have some clarifications to the following questions.

1)  What is the exact procedure to upgrade the status of petition ? should we send documents (Naturalization certificate copy ) to them by mail?
2)  How much time does USCIS takes to upgrade the file?
3)  Do We have to send i130 Upgrade request to NVC as well?

I would Suggest you to get in touch with local congress office and have them help you in this, this happened with me and I have to take help of local congress representative. USCIS took over 4 months to approve my case. they never initially updated my petition but when Congress office got involved, they approved my case in less than 45 days. Dates below if this could help you.

Request to upgrade on June 4th, 2020. (Called USCIS, Send letter to USCIS, Uploaded Certificate on online account)
