I130 DENIED/I-290B MTR FILED

HI,

My I130 got denied as USCIS said i didn't respond RFE within alloted time. Fact is, i've responsed to them within alloted time also USCIS updated my case that they received RFE eveidence. I've all the supporting documents to proof that i did respond timely to USCIS. Thus, i filed MTR through I290B along with all supporting documents along with RFE documents to USCIS on 0ct 6 2020 since i had no option to appeal against USCIS decision. They received I290b from and issued a case number on Oct 26 2020.  How long USCIS can take to process I290B ? Can anyone pls advise how can i expedite this process  or should i seek help from congressman to intervene to my case ?

RFE ISSUED: FEB 20 2020

RFE RESPOND: MARCH 05 2020

DENIED: SEP 23 2020

I290 FILED: OCT 6 2020

Filed i-290b for brother on Dec 24 2019, got approved Dec 9, 2020. Thats almost a year.

what happened with your case ? did you file I290B as appeal or MTR ?

Hello Tusher, 

 

        Did you get your MTR and Visa approved? I am too in similar situation with my I129 petition, USCIS received the RFE response which was requested and they even updated in their system yet my petition was denied stating that response to RFE request was not sent to them. 

 

Your response will be really helpful to me.

Yes, I130 is approved, case is at NVC now.

Thanks for the response and congratulations for your petition approval... Can you tell me the date when it was approved? It will help me to ball park the timeline regarding my petition.

No, didn't hire lawyer, filed i-290B by myself. Thanks.

Oh ok thanks. We are tryin to hire one and it’s gonna cost us 3,500. We got denied over the RFE letter we didn’t receive. I was only able to find out 6 months later when i check the case status.
