Embassy stage - evidence of ongoing relationship?

We submitted a heavy petition with alot of high-quality evidence: we lived together for over a year with a lease, traveled to several countries together, and proved it all with solid documentation and a few pics to back up the evidence. I feel we have a pretty solid case and we received no RFEs. It appears that the NVC only had the case for very few days before they sent it to the embassy - I assume this means they also found it to be solid.

 

I'm going through the P3 for the embassy in Cambodia. #5 is "Evidence of Relationship". Are they asking for the same evidence again? Or are they asking for any evidence that occurred since we filed? I left Cambodia in June. We FaceTime every single day and text throughout the day. We aren't connected on Facebook because I don't use it. I don't send letters or "gifts" because the mail in Cambodia is terribly unreliable and up until just recently, they weren't processing international mail because of Covid. I don't send him money because he works and doesn't want/need it. Are they asking for another letter of intent to marry or do they want screenshots of text messages? What else should include?

It sounds like you took great effort in preparing your case.  Your fiance will have to provide relationship evidence during the interview.  The only thing NVC does for a K-1 case is to assign a case number before sending it to the consulate (assuming the consulate is accepting K-1s).  Neither USCIS nor NVC checks any ongoing relationship evidence.  That job belongs solely to the Consulate officer.....good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you for the feedback. What kind of evidence do they want? What could we provide in the interview to support ongoing relationship? I fully intended to go to the interview with him but it's nearly impossible now with Covid.

Per the VJ guide for K-1s:

When is your interview if you don't mind me asking? Our second interview is coming up here very soon. 

 

Going by the Cambodia portal Consulate reviews, Cambodia isn't known as the most friendly/easy embassy to go through, although the couples that have stated that they were at their significant others interview did seem to fair better, as the reviews seem the consulars are overwhelmingly harsh to the Cambodian native and nicer and more friendly to the U.S/other country fiance. 

 

As for what I sent, since people are unable to get into Cambodia as they aren't doing tourist visas right now, I've sent quite a bit of extra things for my fiance to have. 

 

Everyone's case is different, but for us with one denial already, we are really going heavy on the proof of relationship. 

 

I've sent letters from friends, family,  co workers. People who have known me for many years. She has letters from her co workers who I've met for lunch on a trip over there last year. All signed and dated "under penalty of purjury". Will these do much, I'm not sure, we just want them to know we don't hide our relationship from anyone, and everyone close to us, knows about our relationship and want to marry and have a family. 

 

I've included letters from my parents, a certificate of Ministry from my mother, as she has talked about wanting to officiate our wedding. Due to Covid, those plans will most likely change. 

 

Proceeding our denial, I went and spoke with my states Congressman, which I talked with to see about getting a more solid answer for reason of denial vs just 221G. Which they emailed the embassy, but unfortunately got the same generic response I did. I included my correspondence with them. 

 

She cut screenshots of our facebook messages, a few in the beginning and end of each month since the denial. She also cut and printed out our Skype call history since the denial. 

 

My fiance like yours, works and is not in the predicament of needing money every month. I do send her money for her birthday to get something nice and send some if she ever needs a little extra when something unexpected comes up, like her motorbike needing a repair. I didn't include any of the western union receipts, it feels like such a grey area and you'll get a different answer from each person that's asked if they should be included or not. 

 

We do currently just have a plan to marry at the court house, since we don't want to have people around and put their/our, health at risk. But I'm not sure if there really is anyway I can send proof that is what our plan is. 

 

We also didn't know exactly when Visa services would resume, so certain things had to be put on pause. Now that we know the interview date, we have a bit more room to work with. 

 

We also did both include an up to date letter of intent to marry that she will bring to the interview.

Our case is currently in transit, set to arrive this coming week so we don't have an interview date yet. We're already working on the stuff we have to get done (paperwork, etc.) and hoping to file the DS160 very soon.

 

I've read all those reviews of the consulate and the conclusion that I came to is most (not all) of the people getting denied either have alot of red flags or they just don't have their act together. Some people did everything right and still got denied. Others yet seemed highly questionable and got approved. So for me, it's hard to measure the dynamic of approvals/denials because of all the mixed reviews. I feel like our case is strong because I actually lived in Cambodia with my fiance for a little over a year, went to language school, shared mutual friends, traveled together to multiple countries, etc. We included a lot of quality evidence to back that up. We are way above and beyond the meeting requirement. I feel like an objective and logical IO will see that there are no red flags or issues, but then again I have no idea how they will see it.

 

My issue now is compiling evidence of ongoing relationship. We FaceTime 1-2 times a day and text all day long. We are still fully vested and want to be together, we've just been patiently waiting through the slowdown. I don't use Facebook or social media, I don't send him money (doesn't want/need it), and I don't send him mail/packages because international mail in KH has been shut down since I left until just recently. So we are hoping that the "evidence" we do have will be sufficient when coupled with our petition and the evidence therein. As far as letters from friends/family go, I have a small group of close friends and very little contact with my family. He could get letters from his family/friends but I don't know how seriously the embassy will even take that because there is so much shadiness there and getting someone to write a letter carries little legitimacy.

 

As far as our wedding goes, we are going to do a simple courthouse marriage and then something with our friends/family down the road when this Covid thing is over.

This is my suggestion and what we used at my wife's interview. We followed the directions in our P3 which are similar to Cambodia's embassy. We provided 6-12 photographs (I used word and posted four to a page and printed them using a laser printer for better quality) and some chat logs. We included charge receipts and airline flight information to back up the meeting.  I didn't go overboard with my evidence. Most embassies don't look at this information but it's best to be prepared. DON"T bring a large binder to the interview as the interview will only last about 5 min. The CO usually have their minds made up about your case and the line of questioning during the interview will only be used to confirm what is the totality of the evidence that you have submitted.

 

I recommend not using affidavits for support as they can be viewed as fraudulent. Remember the CO needs to be convinced that you have a bonified relationship. Any evidence you provide must have that in mind. You may want to read some of the embassy's Consulate reviews here on VJ.
