Tourist Visa and I130

Timeline

I am a USC and filed I130 for both my parents who live in India. 

My parents have a tourist visa that expires next year (2021) and have had it and traveled on it for 10 years now for 2 to 3 month durations every other year. No violations. 

My father's I130 is approved and my mother's is pending. We do not want to move to the next step of NVC processing yet due to multiple reasons

1. We'd like both my parents to go through this step together so that they can both get the GC at around the same time. 

2. For the interview, they would both need to travel to another city, which in the middle of a pandemic is a bad idea. 

3. There is no rush for them to move the US at this time. 

4. There aren't any immigration visas for families being processed at this time anyway. 

 

The question at hand is, can we file for visitor visa renewal for them both given that their visas are about to expire and one has a pending I140 and the other has an approved one?

9/4/2013 - (8pm - Pacific) Email/Text for I-130 approval! (Took 405 days)

9/8/2013 - Hard Copy NOA2 for I-130

8/12/2013 - Biometrics appointment letter (Scheduled for 8/28)

8/13/2013 - Successful walk-in Biometrics done.

8/28/2013 - Scheduled Biometrics

8/28/2013 - Status for I-485 changed to "Testing and Interview"

9/17/2013 - Got an email & Text at 4am Pacific for Interview date (October 21)

9/19/2013 - Got the interview letter in mail.

10/9/2013 - Got emails and texts about EAD and AP going into production.

10/15/2013 - Got another email and text about EAD in production.

10/18/2013 - EAD updated to "Card sent"

10/18/2013 - EAD updated with USPS tracking number (expected delivery on 10/21)

10/21/2013 - EAD/AP Combo card received.

10/21/2013 - Interview day (Los Angeles - review)

10/21/2013 - Another update to the I-485 (Decision - Registered as Permanent Resident)

10/23/2013 - Another text/email for card in production.

10/28/2013 - Card ready to be picked up notification. Later in the day got the tracking number.

10//31/2013 - Received the card today! Yay!

I-751 (Removal of Conditions)

7/22/15 - Documents sent
7/24/15 - NOA1 (Received in mail on 7/29)
8/19/15 - Biometrics done
1/6/16 - Approval email and text :dancing::dancing:

Yes, you can apply for a visitor visa even with a pending or approved I-130.


There is no guarantee it will be approved but they are not blocked or barred from applying.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

You can apply to renew it, sure. 
 

I am not sure I understand the reasoning, though. If they can’t travel to another city because of the pandemic, how would they use a tourist visa?

For some reason I think India has a different system and you can renew a B?

It’s not just India, but yes some countries have the option to renew a b visa without having to interview again. India’s specifications are here https://ustraveldocs.com/in/renew-visa.html

I presume OP is aware of this and that is why s/he is asking, given that s/he does not want parents to travel to another city for a visa interview
