Hello friends.

 

Does anyone know what this update could mean for K1s? Apparently, K1 are now consider inmediate relatives of US nationals. 

 

Thoughts on this?

That sentence is missing a comma before "fiancé(e)s." By law, K-1 are not immediate relatives of US citizens. https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title8-section1151&num=0&edition=prelim

There is a ,missing comma after the end parentheses. . .  K1's will be prioritized, but it is up to the consulate.

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Reading that quote to the END you left out the most important part that pertains to all visas including K-1. If your embassy is not open and not adjudicating visas, then the paragraph that you quoted, and the meaning of the entire paragraph does not apply to you.

 

An embassy or consulate will resume adjudicating all routine nonimmigrant and immigrant visa cases only when adequate resources are available, and it is safe to do so.

I'm sorry but that was not my point. I was aware of that. I was just asking for an interpretation on that (point made by some users before) If this new uptdate included fiancés as inmediate family members.

I'm sorry but the interpretation of my explanation was that there is a two part to your question. First part is the K-1 affected by the decision and the second part that I opined with needs must be included in the conversation. You received the answer to the first part made by some users before you.

I think it means that  K-1s will now be considered Immediate Family Relatives of U.S. citizens. Hoping this will bring good news this week or very soon. Yes, it all depends on when embassies can adequately and safely open, but many embassies are already doing visa interviews.

Ok. I was just trying to understand their announcement from November 12th. Perhaps we are mistaken but I hope they did elevate K-1s so that we can get interviewed soonest. Cheers

It does not mean that.  There is no legal relationship between fiances.

Wishful thinking.  There is no legal benefit to a fiance. Are you filing taxes together? Can you get health insurance together? Is there a right of survivorship? If this things are important to you then you need to be married.   

 

DOS will consider you a priority if the consulate is open (and your case will need to be sent there).  Will it be the same priority as spousal?  It doesn't say that.   It simply says it will be a priority.

So are you saying DOS will instruct open consulates to give K1s priority? And what does priority even equate to? It's confusing because this whole "priority phrase" has been dangling over our heads since August but doesn't seem to make a difference.
