SSN, MARRIAGE CERT AND AOS

Timeline

Hello everyone! Help please! I haven't applied for my Social Security Number but we are already getting married tomorrow. Is it okay to get married first without the SSN? Can I apply after I get my marriage certificate and can I apply for AOS without my SSN? Will there be a problem if I get married first, apply for SSN then apply for AOS

The first thing you should have done was get the SSN.

 

You do not need it to AOS.  You won't get the SSN until you EAD or GC arrives.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Having more pressing issues with your marriage tomorrow SSN shouldn't be a high priority. Get married and then file for an SSN. You'll find instructions in the guides tab on the blue ribbon at the top of this page. Congratulations on your marriage.

I’d say you’d better wait ‘till you have your marriage certificate because if you’re planning to adopt your husband’s name (if that’s the case) you’ll have to update your SS card anyway.  

You can also apply for one at the moment of adjusting your status. 

See which one is better for you, but try to avoid having to visit the SSA multiple times, specially in this time we’re living now.

Some have reported issues with trying to get SSN card in married name; i.e. it took SSA too long and the timeframe to get SSN with K-1 passed. In those cases, they had to wait until EAD or GC was approved.

 Even if you get married tomorrow, try to get your ss card using your I-94 and passport. That is what is in the SAVE system now. If you wait to use your married name with your SS application, the names won't match, and you will have to wait 7-8 months for your EAD card to get your SS card. Not a good position to be in. Make an appointment ASAP and get the card in your current name so you can get it in a week or so. Then you can go back and update it after you get EAD AP card. That's 7-8 months away minimum. By then it will be easy to get into a SS office. My wife came on a K1  and we applied for her SS card about 18 hours after coming thru POE, and she had her card a week later.

Or, just take the easy way like we did, my wife kept her last name. Doesn't make you any less married, and we have had no issues so far. It's been nice not having to change names on passport, ss card, state ID, etc. Made life easier for us all the way around without the name change.
