Hi Friends,

 

My frined (US Citizen) 's son is going to attend an interview in Mumbai.

Few questions that he asked to me and I din't have answer to those to asking you guys in here.

Please help me.

1. his son is 3 years old, did he also need to get PCC (police clearnace certificate ) and also did he need to have his finger prints done.

2. What about 3 years old medical ? did it need to be done ??

3. What is the income he needs to show- there are total 4 members in the family- my friend-his mother-his wife, his son . son and mother are going to have interview in december first week.

4. he has a new born daughter- ( 6 months)- does new born will also be counted when calculate poverty line ??

5. Affidavit of support was submiited from m ore than a year . do he need to submit new affidavit of support or not ?

Wait. Son will become USC on entry (assuming he will live with father in the US). There is an exemption for affidavit of support in this case. https://www.uscis.gov/sites/default/files/document/forms/i-864instr-pc.pdf See exceptions for who needs to submit, item 2 on page 2.

That is also assuming biological or legally adopted child. Stepchild relationship doesn't get citizenship from INA 320. We're getting second hand information on OP's friend's family case.

He was just Greencard holder at the time... he was not US Citizen when his son was born.

Like SusieQQQ mentioned, instead of I-864 your friend will upload for his son something like "Under the Child Citizenship Act (CCA), my son will automatically become a U.S. citizen after IR-2 entry."
